Bruce Browne (Ben Boyajian - Owner) Tax Map: 060 Parcel: 39 Zoned: HC EXISTING ACTIVITY Vacant Presently (Proposed Restaurant) PROPOSED VARIANCE The applicant requests relief from Section 30.5.6.2.1 of the Albemarle County Zoning Ordinance to allow a trellis to be located 92 feet from the highway right-of-way; a variance of 58 feet. ZONING ORDINANCE REQUIREMENT Pursuant to Section 30.5.6.2.1, no buildings or structures other than necessary accessory appurtenant fences and/or walls, except as hereafter provided in the case of certain signs, shall be constructed within any SA-highways overlay district. STAFF RECOMMENDATION: Variance, VA-82-16, was approved by the Board of Zoning Appeals on May 11, 1982. The variance allows the trellis to be constructed 105 feet from the highway right-of-way, a variance of 45 feet. The applicant wishes to extend the trellis across the remaining west front of the building. Existing renovation of the portion adjoining the new section of trellis is for a restaurant.
