Dear Sirs:
This letter is to inform you that on December 14, 1982, during the regular
meeting of the Albemarle County Board of Zoning Appeals, your application
for VA-82-71 was approved with a five year limitation. This variance
approval allows relief from Section 4.15.3.4 of the Albemarle County Zoning
Ordinance to allow two (2) for sale or rental signs, a variance of one (1)
sign; and also to allow two (2) fifteen (15) square foot for sale or rental
signs, a variance of 26 square feet.
Enclosed please find copies of the sign permit application which should be
completed and returned to our office along with the fee of $10 for each sign.
Pursuant to Section 35.0 of the Zoning Ordinance, the actual costs of any
notice required under the code shall be taxed to the applicant, to the
extent that the same shall exceed the applicable fee set forth in this
section. Failure to pay all applicable fees shall constitute grounds for
the denial of any application. Please see the attached bill for the amount
due of $1.41.

PROPOSED VARIANCE
The applicant requests relief from Section 4.15.3.4 of the Albemarle County
Zoning Ordinance to allow two (2) for sale or rental signs; a variance of
one (1) sign. Also, the applicant requests relief from Section 4.15.3.4
to allow two (2) fifteen (15) square foot for sale or rental signs; a
variance of 26 square feet.
ZONING ORDINANCE REQUIREMENT
Pursuant to Section 4.15.3.4, Sale or Rental Signs: Provided: (a) not
more than four (4) square feet in area; (b) not more than one (1) on any
lot or premises.
STAFF COMMENTS:
The subdivision (development) is located off Rt. 631 (Rio Road) , approximately
1000 yards on Penn Park Road. The location of one sign to be visible from
both directions of traffic flow is a possibility. (A V-shaped sign)
We do find that this situation does have a uniqueness in that the main entrance
is from a second road, by which you only have access. Penn Park Road inter-
section is located on a curve and thus does present the problem of visibility.

Dear Andrew:
Gercke Development Company, Inc. is presently developing a 69+
acre parcel of land adjoining Pen Park on Rt. 768 (Pen Park Road)
including a .928 acre parcel with frontage on Rt. 631 (Rio Road) .
The development is known as "RiverRun". The entrance into the
development is 1/10 of a mile off Rio Road and cannot be seen upon
entering Pen Park Road (Exhibit #1) .
The allowed four square foot "sale or rental sign" will not permit
visibility to moving traffic at the corner of Rio Road and Pen Park
Road. As you will see in Exhibit #2 & #3 there presently exists on
this essential corner 3 curve warning signs, a telephone pole, a state
route and stop sign and a massive 12' tall "Pen Park" sign.
It is our desire to construct two signs not to excccd fifteen square
feet each in a design and location as shown on the attached sketch and site '
plan. We expect to clear and plant an appropriate area around the signs
to visually draw public attention into Pen Park Road. We expect the signs
and the surrounding area to be tastefully presented and contribute in
a positive way to this very restricted site.
It is estimated that the signs will need to be positioned into the site
no more than ten to twelve feet from Rio Road and Pen Park Road in order
to maintain visibility to nnving traffic.
We will appreciate it if you can evaluate our situation at your earliest
convenience. I will be glad to meet you at the site and furnish any
additional information you may need.
