THIS DEED OF DEDICATION made this 10th day of March,
1982 by and between William A. Marshall, Jr. and Rachel K.
Marshall, husband and wife, parties of the first part and the
County of Albemarle, a political subdivision of the Commonwealth
of Virginia, party of the second part, Virginia' National Bank,
Bondholder, party of the third part, and Myron E. Tremain and
Harold D. Morris, Trustees, parties of the fourth part,

That Grantors GIVE, GRANT, CONVEY and DEDICATE TO
PUBLIC USE unto the County of Albemtarle, subject to the
reservations below, a strip of land in Albemarle County, Virginia,
alongthe western edge of property currentlyowned bythe

Grantors on State Route 649, just northwest of U. S. Route 29 in
the Rivanna Magisterial District. This strip hereby _conveyed

measures 25 feet in width and approximately 367.11 feet in
length and is bounded on the west by the center line of State
Route 649 and on the east by a new line running parallel to said
r center line and 25 feet therefrom. The property hereby conveyed
is a portion of a 2.25 acres parcel conveyed to the Grantors by I
• deed of Maxine Leake Williams, et als, by deed recorded May 1,
1981 in the Clerk's Office of the Circuit Court of Albemarle
: County, Virginia in Deed Book 715, page 629 and is commonly
designated on Albemarle County Tax Map 32 as Parcel 140.
The Grantors hereby retain for their benefit and for
the benefit of their heirs, assigns and successors in title a
permanent, non-exclusive easement of right of way in common with,
and subject to the rights of, the public for ingress and egress
to the remainder of their property over and across the strip
hereby conveyed.

PROPOSED VARIANCE
The applicant requests relief from Section 21.7.1 of the Albemarle County
Zoning Ordinance to allow a freestanding business sign to be located 10
feet from the state right-of-way; a variance of 20 feet.
ZONING ORDINANCE REQUIREMENT
Pursuant to Section 21.7.1, Adjacent to public streets: No portion of
any structure except signs advertising sale or rental of the property
shall be erected closer than thirty (30) feet to any public street right-
of-way.
STAFF COMMENTS
The business location has a short visibility range because of the curvature
of the road going west bound. The visual range going east toward Rt. 29
north is good because of the short distance from the site to Rt. 29 north.
We feel that it is feasible to locate the sign at the required setback, but
there is very limited location to meet the requirement. We recommend that
some relief is warranted because of the physical development of the paved
areas, both parking and service.
