Proposed Variance
The applicant requests relief from Section 21.7.1 of the Albemarle
County Zoning Ordinance to allow a freestanding business sign to be
located 1 foot from the highway right-of-way; a variance of 29 feet.
Zoning Ordinance Requirement
Pursuant to Section 21.7.1, adjacent to public streets: no portion of
any structure except signs advertising sale or rental of the property
shall be erected closer than thirty (30) feet to any public street
right-of-way.
Staff Comments
As a tenant of the lower level of the existing building, it does not have
the frontage exposure as the upper tenant. The site itself has limited
area in which to place a freestanding sign to meet the required setback.
We do think that a sign located adjacent to the property line with the
existing utility poles would have effect on the adjacent property - if
lighted.
