THIS DEED made this 18th day of October, 1974, by and
between ROBERT LEE JARVIS and RUTH E. JARVIS, his wife,
the Grantors, and JAMES WILLIAM MORRIS and GLADYS M. MORRIS,
husband and wife, the Grantees,
WITNESSET H:
THAT FOR AND IN CONSIDERATION of the sum of THREE
THOUSAND FIVE HUNDRED AND NO/100 DOLLARS ($3,500.00) cash
in hand paid, the receipt of which is hereby acknowledged,
the Grantors do hereby GRANT, BARGAIN, SELL and CONVEY
with GENERAL WARRANTY and ENGLISH COVENANTS OF TITLE unto
James William Morris and Gladys M. Morris, husband and wife,
as tenants by the entirety with full rights of survivorship
as at common law, and not as tenants in common, all that
certain lot or parcel of land consisting of thirty-four
one-hundreths (34/100) of an acre, more or less, in Albemarle
County, Virginia, in the Rivanna Magisterial District with
all appurtenant water rights, and this being the same property
in all respects which was conveyed to Robert Lee Jarvis by
Deed of Robert M. Callaghan and Robert M. Huff, Trustees,
dated June 10, 1974, and recorded in the Clerk's Office of
the Circuit Court of Albemarle County, Virginia, in Deed
Book 560, page 391.
Reference is herein made to aforesaid deed far a more
particular description of the property hereby conveyed.

Proposed Variance
The applicant requests relief from Section 10.4 of the Albemarle County
Zoning Ordinance to allow a single family dwelling, which will replace
mobile home, to be located 25 feet from the front property line, a
variance of 50 feet; and to be located 25 feet from the rear property line,
a variance of 10 feet.
Zoning Ordinance Requirement
Pursuant to Section 10.4, all structures shall be located a minimum of
75 feet from the front property line and a minimum of 35 feet from the
rear property line.
Staff Comments
The parcel is small in size with shallowness in depth from the State road.
The topography is of a sloping degree toward State Route 649. To utilize
the septic location at its present location, the placement of the replace-
ment home is very limited. We feel that the applicant has basis for a
variance.
