I am writing in confirmation of our conversation this morning that the
pool site for which we requested a variance (application #VA-83-9) has
been officially staked out and is more than 75 feet from the front line.
As a matter of fact, the closest point will be slightly more than 85
feet from the front line. Thus, as we discussed, we no longer need
a variance and I wish to withdraw my application.

To Whom It May Concern:
The variance which is sought is in the zoning requirement for set back
of buildings of 75 feet from the road on the front in Whippoorwill Hollow
or within 35 feet of the side line. We would like to install an in-ground
swimming pool on our property and would greatly prefer for this to be in
the rear of the house. Unfortunately, the property on which our house
is located is extremely hilly, which accounts in part for there being such
a large lot (greater than 6 acres), since it is inaccessible and cannot
be used for building purposes. I had several contractors evaluate the
property regarding building the pool and each tells me that it is impossible
to build anywhere except in the site being sought for variance. To put
it in the rear of the house would require construction of a complete new
road at some considerable expense because concrete trucks and equipment
cannot reach it. The reasons for this are illustrated by a visit to the
site and by photographs which show that there is no acceptable flat area
anywhere on the property, with all the hills being approximately 45° angles.
The one small flat area that is available is adjacent to the pond, is too
small, and is made up of fill dirt which cannot be used for a pool. It
also is a drainage area with a small stream running by it and all of these
factors, as well as its inaccessibility to concrete trucks, mean that this
single flat area cannot be used. Neither side of the house can be utilized
because of extremely steep banks and the most posterior portion of the
property is inaccessible and is in a flood plain. We would therefore like
to have a variance on the code so that the pool can be installed in the
wooded area off the main road. Because of the woods we do not have a front
yard and only heavily wooded areas all around the house. The pool site
would be practically invisible from the road and would be surrounded by 1
a fence to make it blend into the trees. The other portion of the property 1
which we own at the top of the hill is all fill dirt, is not surrounded
by trees, would be very open to anyone driving by and thus would greatly
affect the visual pleasantness that is inherent in Whippoorwill Hollow.
We plan to keep all the trees possible around the pool area and it would
thus not change the outward appearance from those driving around the sub-
division. It is difficult from photographs or from verbal description to
clearly illustrate the problems that are inherent in attempting to find
a pool location site because of the very difficult terrain. I would welcome
an on site visit of the property to verify the problems that we have. We
thus are seeking a variance for geographic reasons and hope that the board
will consider our application for variance favorably.
