Kinza de Launay Tax Map: 062B2 II Parcel: K7 Zoned: RA, Rural Areas Existing Activity Vacant Land Proposed Variance The applicant requests relief from Section 6.5.01 of the Albemarle County ! Zoning Ordinance to allow a single family dwelling to be located 20 feet from Chestnut Ridge Road right-of-way, a variance of 30 feet; also to be located 30 feet from Wild Flower Drive, a variance of 10 feet. Zoning Ordinance Requirement Pursuant to Section 6.5.01, in the case of any subdivision which was approved pursuant to Chapter 18 of the County Code prior to the adoption of this ordinance and which was of record at the time of the adoption hereof, the rear, side and front yard, and setback regulations of the Zoning Ordinance in effect at the time of such approval shall apply to all lots within such subdivision. Staff Comments The lot has a drainage ditch that leads to the culvert which goes under Wild Flower Drive. The topography of the lot is so that there are two (2) suitable building locations. One would be suitable for a standard conventional style house. The location of the second is where the applicant wishes to construct a solar home. To construct this type of home, we feel that there exists an uniqueness of hardship. The closeness of the dwelling to Chestnut Ridge Road should be noted, because sometime in the future this road could be further developed.
