The Board of Zoning Appeals approved a variance on June 15, 1983 to allow your freestanding business sign to be located ten (10) feet from the highway right-of-way. The new sign that has been erected does not meet that ten (10) foot setback. You are hereby given notice that you have twelve (12) days to remove and/or relocate the sign at the proper setback as approved by the Board of Zoning Appeals. Please contact John Grady at our office for assistance on the location of your sign. 4 Enclosed please find an additional copy of this letter to furnish the party responsible for the erection of the sign. Mahanes Tax Map: 75 Parcel: 50 Zoned: RA, Rural Areas Existing Activity Grocery Store Proposed Variance The applicant requests relief from Section 10.4 of the Albemarle County Zoning Ordinance to locate a freestanding business sign ten (10) feet from the highway right-of-way; a variance of sixty-five (65) feet. Zoning Ordinance Requirements Pursuant to Section 10.4 all structures including signs must be located seventy-five (75) feet from the right-of-way in the RA zone. Staff Comments The applicant has an existing freestanding sign. The proposed sign would be a replacement. The visibility from both northbound and southbound traffic is minimum for the existing sign. The elevation of the store/ station is below the road grade. To have good visual contact with the existing sign you have to be within approximately two-tenths of a mile distance. Our only recommendation would be, as applicant has submitted the replacement sign area, that the sign area be no larger than the existing sign.
