Minor, Owner Tax Map : 061 Parcel: 27A (Parcel A) Zoned: R-4 (CO Zoning Requested) Existing Activity Residential (CO Zoning Requested For Doctor's Office) Proposed Variance The applicant requests relief from Section 21.7.2 of the Albemarle County Zoning Ordinance to allow a structure to be located closer than 50 feet to a residential district, a variance of 30 feet. Zoning Ordinance Requirement Pursuant to Section 21.7.2, Adjacent to residential and agricultural districts: No portion of any structure except signs advertising sale or rental of the property shall be located closer than fifty (50) feet to any residential or agricultural district. Staff Comments The applicant proposes to change the use of the structure from residential to office use by application of rezoning. If the Board should wish to grant the variance, the following two (2) conditions should accompany the approval: (1) no additions would be allowed that would encroach on the setback to the adjoining residential property (2) adequate screening should be provided as recommended by the Planning Commission for site plan approval
