Latest data shows that eight tons of aggregate are used annually for each man, woman and child residing in the State of Virginia. Practically all construction projects use these materials. The local availability of construction aggregate is a valuable asset to the members of any community; it reduces costs to the user, its plants provide jobs, pay taxes and purchase goods. However, a delicate balance of criteria must be achieved in order to have an operation that is desirable to both the operator and to the community. Chief considerations for this center around: 1 . A good market for the product, 2. A natural aggregate deposit of quality and sufficient quantity, 3. Access to the market, 4. Environmental - can the operator co-exist with minimum change to the area. Sites that meet all of the above criteria are unique and should not be wasted. For this reason the Virginia Aggregates Association and the Virginia Division of Mineral Resources bring this important set of guidelines to you for preserving and utilizing your county' s natural resources through zoning procedures. It will be through a joint effort of better understanding, good preservation practices and proper planning that the aggregate industry will be able to provide the products that are basic .yet so vital to the growth of your community and the state. I have taken con- siderable time to research the possibility of a drafting error that excluded parcel 20 from the NR zoning district as a result of the 1980 zoning map amendment . I have been unable to ascertain the existence of such an error. However, I have found that the 1980 zoning map amendment undertaken by the County was indeed a long and complicated matter. This process also allowed for considerable public input. Those individuals who had specific concerns regarding any zoning map change proposed by the County were afforded an oppor- tunity to express their concerns at numerous public hearings. In ' reviewing the Board of Supervisors minutes, I was unable to find any such request by Luck Stone Corporation. I have discussed this matter with the Deputy County Attorney and several other key staff members. Based on those discussions and the lack of any evidence supporting your claim, it is my recom-+ mendation that you seek a rezoning of parcel 20. In my opinion , you should have no problem with such a request . Also, please feel ' free to come in and research the Board of Supervisors and Planning Commission minutes to your satisfaction. In reference to your proposal for a fill operation on Parcel A, please be advised that you must secure a grading permit for any '', ''sIr► earth disturbance of 10, 000 cubic yards (aggregate volume) or greater from this office. We discussed many points relating to our Charlottesville Plant, and perhaps this letter will serve to clarify our discussion in your office. The first item we discussed was that of our concern that the Albemarle County Zoning Map still does not show all ,0" our property at the Charlottesville Plant as being within the Natural Resources Overlay District. Our property there consists of 2 (two) parcels; parcel 7 (127 acres) , and parcel NINIF 20 (11 .5 Acres) , totaling 138"5 acres (see enclosure 1 ) . We first addressed this problem with the county in January, 1975. when changes to the Ordinance were being propo—i-Er._. In our letter to Mr_ Humphries Enclosure 2, p. 1 & 2 of 37 , we informed him of the current use of the entire 138.5 acres and requested that the Resources Overlay District in lude that 138.5 acres. The information which we had at that time disclosed the District included only that portion of Parcel 7 between the C & 0 Railroad and Route 250. (See Enclosure 1 p. 3 of 3). In February of 1976, we received a letter from Mr. H. P. Clarke to serve as a Certificate of Occupancy ( Enc. 3) for Charlottesville Stone Corporation which, of course, was operating on the 138. 5 acres as Mr. Humphries had been notified of in January, 19/5. N��� Subsequent proposed Ordinance Maps showed even more radical limits to our operation. Enclosure 4 is a copy of a map received by us some time between 1976 and 1979. Here the Resources District includes all of Parcel 7 south of the C & 0 Railroad, but eliminates the eastern third of Parcel Burkeville 7, north of the C & 0 Railroad, and all of Parcel 20. I attended a hearing at the Shadwell Elementary School . The small ,, map handouts clearly showed that , again, our entire operation was not included. Upon explaining this to a member of the 41101ed Planning Staff, I was advised to visit the county offices bc.p...!:,,27, and look at the master Proposed Zoning Map on display. I was informed that a possible crafting error had occured.* My visit, the next morning, resulted in my determining that the 138.5 Acres was, on the master Proposed Zoning Map, ,__( wholly within the NR District-I' Much to our disappointment / we discovered, after the adoption of the Ordinance in 1980, that, Parcel 20 was still excluded. Later, in talking to Mr. Bob Tucker about it, he informed me that the Proposed Map was, during the final days, undergoing daily changes and some things "fell thru the cracks". It was understandable to us and of little concern as we felt we had been completely open with the County. We believe it was a simple oversite by a draftsperson. Today, however, the oversite is of more concern. As Mr. �.�.�eV Bill Nelson, Vice President of Luck Stone Centers, informed ' you, we are considering, in the not so distant future, an expanded use for the eastern half of Parcel 20. Our decorative stone sales are being conducted from our scale office at the main entrance. We are considering the possibility of relocating that portion of our business to the above mentioned area. Building, entrance and sign permits would be applied for. In conclusion on this first item of our discussion, there are 2 (two) points I would like to make you aware of. Firstly, the tax records reflect that Parcel 7 contain 160 Acres. -�p'��' The old County records refer to the Parcel as containing P . "approximately 160 acres". A certified surveyors plat shows �`e the Parcel to contain only 127 Acres. I will provide you a copy of the plat if you desire. Secondly, the l3$.5 arrec / has been under State Permit to nine for more than 12 (twelve) years (See Enclosure 5). We have been paying a bond or yearly fee into the State Reclamation Fund for the 138. 5 acres. We would be most appreciative of getting this matter finally resolved, hopefully thru the long awaited correction of the Ordinance Map. The second matter we discussed will hopefully be easier to explain. We recently purchased Parcel A (10. 1 Acres) which is clearly not in the NR District. The land was purchased to provide a buffer along our southern boundry. We do not propose to conduct extraction, storage, or processing on Parcel A. We do however propose to construct earthen berms and conduct fill operations on this property. No fill in or disturbance of the 100 year flood area will occur. Page 3. Under Chapter 16, Title 45.1 , Article 1 , Luck Stone Corporat7on will be required to obtain a permit from the Division of Mined Land Reclamation and pay into the Reclamation Fund. 'i"" The site, during fill operations, will be inspected by the Area Supervisor of DMLR. The operation is expected to continue for more than 5 years. Title 21 , Chapter 1 , Article 6.1 of the Code exempts surface mining operations from the Soil & Water Conservation Erosion and Sediment Control Law under which most co.anties formulate their guidelines. To minimize conflicting guidelines, inspection procedures, � �o and to avoid a duplication of regulatory agencies' efforts, tJ we would like to see the Division of Minded Land Reclamation •rll oversee this project. We do, however, appreciate Albemarle County' s interest in a proposal of this nature. Perhaps a review and approval of the grading plans by Albemarle County, prior to submital to the State, would be a step in the right direction. Box 29682 Richmond, VA 23229 Dear Joe: Thank you .for meeting with me last week. The short tour gave me a better understanding of your operation. I have reviewed Title 45. 1, Chapter 16, Article 1 and Title 21, Chapter 1, Article 6.1 as well as the Albemarle County Zoning Ordinance which includes the County ' s Soil Erosion Ordinance as they pertain to Luck Stone Corp. proposed operations. I have also) discussed the question of whether or not the County would require certain permits in addition to those required by the State with the Deputy County Attorney, Fred Payne, and County Engineer, Maynard Elrod. This, of course, is in reference to the proposed fill opera- tion on Parcel A, Tax Map 79 in conjunction with the quarry opera- tions. It is our general opinion that the proposed fill operation would be exempt from County soil erosion control regulation. Con- sequently, this means that if the property is rezoned to Natural Resource, NR, and the plans for your operations are approved by the State, there would be no additional soil erosion requirements (i.e. , bonding, etc. ) . That would be a function that the State would be responsible for under the aforementioned titles of the State code. There is, however, one section of the Zoning Ordinance that would still apply to these proposed operations. Section 30.4. 3 (copy attached) requires that a permit be acquired from the Zoning Administrator prior to. commencing any natural resource extraction activity within any NR district . This requirement may be complied with by filing a copy of your State approved plan with this office. Page 2 Letter to Joseph Andrews, Jr. October 5, 1984 Also, as stated in Forrest Wiseman' s letter (June 22, 1984) , the County would be very much interested in the review and approval of your grading plans prior to submittal to the State. This is a concern of mine as you know, because the proposed fill operation would be located on a "sensitive" site with the school on one side and a flood plain on the other. In reference to establishing new retail activity on parcel 20; as we discussed, my opinion is that appropriate zoning should be sought to accommodate such use. I don' t think the intent governing nonconforming usesis maintained by relocating the existing non- conforming retail use to a different location on the property.
