Zoning Ordinance Requirement
Pursuant to Section 10.4, all structures shall be located seventy-five
(75) feet from the front property line or access easement.
Staff Comments
The lot does not have any topography problem as far as location of the
proposed house. The lot has adequate depth at one end of lot for the
house to meet the setback regulations, but it could create a problem of
the septic system location. The approval if granted should be conditional
that no addition could be added to the front of the house that would come

B & S v WHEREAS, by deed bearing date the 10th day of October,
1. J. Harless 1 1888, of record In the Clerk's Office of the Circuit Court of Albemarle
Fee ! 2:25 fj County in D. B. 98, page 461, Robert M. Harris, and others, conveyed to

on the east side of the public road described as leading from the Thompson
ia-4-CE44 neighborhood to Millington, in White Hall Magisterial District, containing
one acre;
AND WHEREAS, the said lot having become useless for
school purposes the party of the first part directed that the same be adver-
tised for sale in acco±dance with law;
AND WHEREAS, after such advertisement the same was
offered for sale at public auction on February 4, 1938, at the front door
of the Court House, at which offering an insufficient bid was made and
rejected, and after further advertisement the said lot was again offered at
the same place at eleven o'clock A. M„on August 6, 193 , at public auction
at which offering the sum of $50.00 was bid, which offer was likewise rejected;

AND WHEREAS, the said party of the first part has
now received from the party of the second part a private offer of '50.0n in

1 cash for said lot, and has duly filed its petition in the Circuit Court of
Albemarle County setting forth all these and other facts necessary to enable
the Court to pass upon the subject; and
WHEREAS, the aforesaid Circuit Court of Albemarle county
on the 28th day of June, 1939, entered an order ratifying and approving the
sale of said lot to S. J. Harless for the si1m of 050.00 in cash, and directed
the party of the first part hereto to execute and deliver a deed therefor
upon the payment of said purchase price;
NOW, THEREFORE, In consideration of the premises, and
,, especially in consideration of the said sum of $50.00 in cash, paid by the
party of the second part to the party of the first part, the receipt of which

BARGAIN, SELL AND CONVEY WITH SPECIAL WARRANTY, unto the said S. J. Harless,
party of the second part hereto, all that certain lot or parcel of land
