Lohr Tax Map: 61W1 Parcel: OB-13 Zoned: R-4 Existing Activity Single Family Dwelling Proposed Variance The applicant requests relief from Section 4.11.3.2 (b) and Section 6.5.01 to allow an addition to be located 5'6" from the side property line; a variance of 4'4". Zoning Ordinance Requirement Pursuant to Section 4.11.3.2 (b) , unless constructed to a common wall, no such structure shall be located closer than six (6) feet to any lot line. Pursuan to Section 6.5.01, in the case of any subdivision which was approved pursuant to Chapter 18 of the County Code prior to the adoption of this ordinance and which was of record at the time of the adoption hereof, the rear, side and front yard and setback regulations of the Zoning Ordinance in effect at the time of such approval shall apply to all lots within such subdivision. Staff Comments We note that applicant does have a limited space for expansion to the rear of the dwelling. The six foot limitation should not be exceeded for fire safety. Even at six feet, the applicant will have to meet more stringent fire regulations than would have to be met at the ten foot requirement.
