Pflug, Jr. , Trustee Tax Map: 05 Parcel: 02 Zoned: RA, Rural Area Existing Activity Two Single Family Dwellings Proposed Variance The applicant requests relief from Section 10.4 of the Albemarle County Zoning Ordinance to allow a structure (farm house) to be located 45 feet from Rt. 624 right-of-way; a variance of 45 feet. Also, applicant requests relief from Section 4.6.3.2 to allow structure to be located 45 feet from deeded right-of- way; a variance of 15 feet. Zoning Ordinance Requirement Pursuant to Section 10.4, all structures shall be located 75 feet from a right-of-way, and pursuant to Section 4.6.3.2, other yards adjacent to streets shall have a minimum width or depth, as the case may be, of eighty (80) percen. of the minimum front yard depth required in the district in which the lot is located. This provision shall apply to lots in the RA or residential district only. Staff Comments The applicant's land shows elevations that would be affected by a 100 year flood storm (Army Corps of Eng. Maps) . Two properties are separated by the State road of Rt. 629 and a right-of-way that serves a tract of land to the rear of the applicant. Our only recommendation would the delineation of the front of the applicant's property be made by re-erection of the rail fence approximately 40 feet in distance across the front.
