Baber, owner Tax Map: 85A Parcel: 15 Zoned: RA, Rural Area Existing Activity Single Family Dwelling Proposed Variance The applicant requests relief from Section 10.4 of the Albemarle County Zoning Ordinance to allow a single family dwelling to be located 30 feet from the highway right-of-way; a variance of 45 feet. Zoning Ordinance Requirement Pursuant to Section 10.4, all structures shall be located a minimum of 75 feet from a right-of-way. Staff Comments The property has an existing structure (house) that will be replaced with the proposed dwelling. The adjoining western properties dwelling is located less than thirty (30) feet from the road right-of-way. Eastern properties dwelling is approximately thirty (30) feet from road right-of-way. The proposed dwelling at the thirty (30) foot setback would be an improvement of the existing structure. The topography of the lot eighty (80) to one hundred (100) feet from the road is the toe of steep slope.
