Vaughn Director of Inspections Zoning Administrator 401 McIntire Road, Room 2-2 Charlottesville, VA 22901 Dear Mr. Vaughn: Reference is made to Mr. Evans' letter of July 29, 1983, with regard to the application of McDonald's Corporation (Jefferson Savings and Loan) for relief from Section 21.7.1 of the County Zoning Ordinance to allow a sign to be located 10 feet from the public street right of way, a variance of 20 feet. A public hearing on this matter is scheduled for August 16, at 3:00 p. . l We ask that the Board of Zoning Appeals deny the request for a variance of the ordinance for the following reasons: 1) Adjacent property owners (i.e. First Virginia Bank-Central) have complied with the sign ordinance and did not feel that a variance was necessary. 2) The installation of a sign 10 feet from the street right of way may block the street view of our property thereby having a negative effect on the conduct of our business. 3) Maintaining the integrity of the County Zoning Ordinance with regard to signage is important to the Pantops area, if it is to continue to develop commercially in an esthetically pleasant manned. 4) The granting of a variance will give this developer a commercial advantage over businesses that have followed the ordinance. We do not think that the ordinance presents a hardship toward successful development of this property, and we encourage the developer to continue theid efforts but without the unfair advantage of a zoning variance that could be detrimental to other businesses in the area. Zoning Ordinance Requirement Pursuant to Section 21.7.1, Adjacent to public streets: No portion of any structure except signs advertising sale or rental of the property shall be erected closer than thirty (30) feet to any public street right-of-way. Staff Comments The site has good visibility from both east and west bound traffic. A freestanding sign could be located at the required setback of 30 feet and still offer good exposure. A variance was granted for a near by property of 15 feet (Boddie-Noel - Hardees, VA-82-8) .
