Rinehart Construction Tax Map: 78 Parcel: 114 (Section 2, Phase I, Lot 5, Ashcroft) Zoned: PRD Existing Activity Single Family Dwelling Proposed Variance The applicant requests relief from Section 6.5.01 of the Albemarle County Zoning Ordinance to allow a single family dwelling to be located 25 feet from the front property line; a variance of 25 feet. Zoning Ordinance Requirement Pursuant to Section 6.5.01, in the case of any subdivision which was approved pursuant to Chapter 18 of the County Code prior to the adoption of this ordinance and which was of record at the time of the adoption hereof, the rear, side and front yard and setback regulations of the Zoning Ordinance in effect at the time of such approval shall apply to all lots within such subdivision. Staff Comments The applicant called for a footing inspection on August 9, 1983. When the footing inspection was checked the location of the proposed house was only 25 feet from the right-of-way. The inspection was rejected. A stop work order was placed on the job site on 8/12/83. The applicant made application for the variance on 8/15/83. Work has continued on the job site as of the date of a report on 9/1/83. Our! department has received a letter from the Health Department in relation to the septic system.
