of the set hack violations and feels that because of the slopes Af
these nrooerties, Randy Rinehart and Suzanne Grove should he oiv,..
annroval for buildinn. DNA stand behind our orininal annroval of
their nlans. It is our belief that in the case of Lot 5 , an err
was made in the original set hack allowances and it should have
been included in those lots orininally desinnated with 30' set
back. Ve also believe that it was our suonestion that Suzanne
Grove site her house as it exists not realizing the violation of
the set hack allowances.

Please be advised that a septic tank permit #SD-83-143 was issued on •
April 28, 1983, for Ashcroft Subdivision, Section 2, Lot 5, approving an
area for the installation of drainfield and alternate site as shown on the
permit.
A return visit to the site was made to determine if the proposed build-
ing site were moved back 30 feet would there still be an appropriate area for
septic system. Such a change would only shift the proposed drainfield site
to an area where there is rock at 24 inches and the slope is greater that
25 per-cent (i.e. unsuitable for drainfield) .

Proposed Variance
The applicant requests relief from Section 6.5.01 of the Albemarle County Zoning
Ordinance to allow a single family dwelling to be located 25 feet from the front
property line; a variance of 25 feet.
Zoning Ordinance Requirement
Pursuant to Section 6.5.01, in the case of any subdivision which was approved
pursuant to Chapter 18 of the County Code prior to the adoption of this ordinance
and which was of record at the time of the adoption hereof, the rear, side and
front yard and setback regulations of the Zoning Ordinance in effect at the time
of such approval shall apply to all lots within such subdivision.
Staff Comments
The applicant called for a footing inspection on August 9, 1983. When the footing
inspection was checked the location of the proposed house was only 25 feet from
the right-of-way. The inspection was rejected. A stop work order was placed
on the job site on 8/12/83. The applicant made application for the variance
on 8/15/83.
Work has continued on the job site as of the date of a report on 9/1/83. Our!
department has received a letter from the Health Department in relation to the
septic system.

Dear Bob,
In regards to Lot 5, Section II, Phase I, Ashcroft Subdivision,
Rinehart Construction Company and the set back on this lot.
It appears after an inspection of this site, that this lot should
have been included in our designated 30' set back on certain lots,
why it wasn't I don't know. It could have been left off the set
back notations by the draftsmen and simply not discovered until
now.
As the developer I have no objections to a variance being granted
on this lot .
