Proposed Variance
The applicant requests relief from Section 30.5.6.2.2 of the Albemarle County
Zoning Ordinance to allow parking to be within 39 feet of the highway right-of-way;
a variance of 11 feet.
Zoning Ordinance Requirement
Pursuant to Section 30.5.6.2.2, no off-street parking or loading shall be allowed
closer than fifty (50) feet to the right-of-way line of a SA-highway which is all
or part of off-street parking facilities required or designed to accommodate more
than two (2) motor vehicles.
Staff Comments
Under Section 30.5.6.3.1 of Scenic Areas Overlay District, the Planning Commission
may reduce the building setback to 75 feet providing that all parking be loca ed
behind the building and be screened from the view of the highway. The applic nt
is not exercising that option.
Our recommendation is that if the variance is granted it be conditional upon
applicant providing adequate screening from the highway. This approval would
also be subject to review and approval by the Planning Commission.
