I, Box 316 Charlottesville, VA 22901 RE: Business Sign Location Certified r#P00 9770776 Variance, VA-83-32 • Dear Mr. Mahanes: My letter is in reference to the location of your new sign on Rt. 29 South. The Board of Zoning Appeals approved a variance on June 15, 1983 to allow your freestanding business sign to be located ten (10) feet from the highway right-of-way. The new sign that has been erected does not meet that ten (10) foot setback. You are hereby given notice that you have twelve (12) days to remove and/or relocate the sign at the proper setback as approved by the Board of Zoning Appeals. Please contact John Grady at our office for assistance on the location of your sign. Enclosed please find an additional copy of this letter to furnish the party responsible for the erection of the sign. /14 We thank you for your cooperation in regard to this matter. Zoning Ordinance Requirement Pursuant to Section 10.4, all structures including signs shall be located a minimum of 75 feet from the highway right-of-way. Staff Comments The applicant and the company that erected the sign did not obtain the proper setback measurement when the sign was erected. If the Board grants the variance it should be with the condition that if road improvements are made by the Virginia Department of Highways or the property owner that would effect the location of the sign, such sign shall be relocated.
