Request for a variance to allow a structure 8 feet 6 inches higher than present restriction of 65 feet The League of Women Voters of Charlottesville and Albemarle County believes that no structure should be allowed a height variance unless hardship can be shown. It is our understanding that the 65-foot height limitation was instituted for fire safety purposes. We wonder what plans the builder has made for the safety of the occupants of the higher level. Those members present were William Roberson, Jr. , William C. Smith, Max C. Kennedy, William Heath, and Carl Van Fossen. Other officials present were Robert E. Vaughn, Zoning Adminis- trator; Jesse R. Hurt, Deputy Director of Inspections; and Sharon Taylor, Secretary. Mr. Kennedy: Alright, 83-66, River Heights Motel-Hotel. Mr. Hurt: Located on Tax Map 45, Parcel 68D(3) , Zoned Highway Commercial, existing activity - hotel under construction. Proposed variance - the applicant requests relief from Section 21.4 of the Albemarle County Zoning Ordi- nance to allow a structure to be 73 feet 6 inches in height, a variance of 8 feet 6 inches. Zoning Ordinance Requirement - Pursuant to Section 21.4, structures may be erected to a height of 65 feet; provided that any structure exceeding 35 feet in height shall be setback from any street right-of-way or residential or agricultural district; in addition to minimum yard requirements, a distance of not less than 2 feet for each 1 foot of heights, height in excess of 35 feet. Staff Comments - Staff wishes to make no comment. Mr. Kennedy: O.K. , somebody here from River Heights? (Inaudible) Mr. Wood: Wendell Wood, I would like to -ah- speak primarily to two of the iss S that I thing probably are involved in the application, those being one of safety and one of aesthetic values, changing the look of the building. And if I would, I would like to a address first the existing building to you. (Inaudible) fr Mr. Smith: Would you put a light on and turn one, one of those lights off. (Inaudible) Mr. Roberson: Ah, Wendell it is -ah- a timer, timed thing, (Inaudible) Mr. Kennedy: Hold that switch up tight -ah- see if it -ah- (Inaudible) Mr. Roberson: No. Mr. Wood: Oh, you have to hold that down. (Cough) Mr. Van Fossen: Turn these back off again, Sharon. Mr. Smith: Go get the engineer. Ms. Taylor: Does that get them off? Mr. Roberson: Nope. (Inaudible) Mr. Heath: Cut them all off. Can you cut them down? (Inaudible) Mr. Roberson: These I think. Mr. Heath: Very good, excellent. Mr. Roberson: O.K. , is that it? Any better? Mr. Smith: Much better, much better. Mr. Heath: Could you turn it down a little bit on that? (End of Tape) Mr. Wood: This is the existing building that is currently seen from 29, if any of you have been out there in the past three weeks, this is erected and at the elevations currently shown. This is the ninth floor -ah- probably from you, from 29 it is only 7 floors. Visibility -ah- what you have seen coming down 29 you, the first floor that you can see is currently this floor right here, the fifth floor. When you look at it from the right as you drive down 29 you do not see the first two floors, the first floor that you see is the fifth floor. Ah- tree level is approxi- mately at this point we are still roughly thirty feet below the tops of the existing trees, so this is, everything that is out there now is completed to the ninth floor. Ah, I would like to drop this down and show what we are proposing on this here stage. Everything, this part of the building from this is this is the south end of the building, down to this point we would remain the same, there would be no change in it. (Cough) From this point to this point we are asking for a variance. This represents less than one-third of the top of the building. Ah, roughly two-thirds we are not, we are not asking for a variance on. This, the roof level here from the parking lot side, which would be served in this case by the fire department, is 61 feet high and for two- thirds of it that would not change. There will be access out of this portion of the building, th- this would be the tenth in what is referred to as the tenth floor would be from here to here so it is probably miss misnumbered. Ah, there would be exit out onto this part of the roof, so they are getting it as far as a fire if somebody should have to get out on that roof. The, the would still be served, two-thirds of the building would be served from the same existing level. This is the variance that we are asking for of eight feet, this part of the the building is four feet below, ah, the existing code. This part would be eight feet -ah- above, the variance that we are asking for so as you can see it is not -ah-, not a great deal of a of a variance. Ah, from a aesthetic point of view with the trees, ah, if you have been by there you can mostly see you can very hardly see the building now, so this is not going to change from an aesthetic appeal from the highway. Ah, Page 3 %iii, Nee VA-83-66 River Heights Hotel, Inc. September 13, 1983 Mr. Wood: From a safety factor, ah, I would like to address is. Mr. Kennedy: Mr. Wood, let me ask you, what is the red thing on the right? i Mr. Wood: That is the, that is the tower, this, the a elevator, the elevator always has to go up above the type of building - this is your elevator shaft and a fire exit, this is all, this is, this is the core of the elevators, lobby, for the elevators and the fire exit. We have a fire exit on each end of the building, ah, two fire ways, two fire exits on each end. Mr. Kennedy: Do you mean by fire exit that there is a stairwell? Mr. Wood: Stair, stairway, concrete, steel, the whole structure is is concrete il slab, block partitions, a steel studs in the building, there is no, n wood in the building at all, the, ah, the convention area is off onto the west of this, then in other words you really is off then into thi direction, set in that this area. From, ah, it represents, the addit o represents less than one-third of the of the tenth floor, it is less, it is not an addition of the whole tenth floor, it is less than one- third, it represents approximately 4,700 square feet. The, ah, from a safety standpoint we feel like we have done the latest in availability I to fire codes. We have designed this for a high rise structure even though it does not qualify as a high rise structure, in other words, we have meet all codes for a high rise building. Ah, that consists of the type of materials that you put in the building. We also are putting in what is called a life support system in the building, which is mandatory in high rise buildings. That is a system that, that every everywhere in the, the building is totally sprinkled also. It is total y sprinkled, each room has four sprinkler heads in each room. There is a sprinkler head in the hallway outside of each room. In addition to that we have smoke detectors in each room that are electrically connected so that they are not battery operated where they (Inaudible) become d a . They are electrically connected and in addition to the electric we ha e a generator in case of a fire, there is a automatic switch where a generator comes on that also will operate the smoke detectors and thi life support system. But briefly will tell you a little bit about li e support system, it is a, actually it has a speaker that goes to each room and in addition to the smoke alarm there is a speaker in each room that in case, ah, there should be a fire, there is a prerecorded message. The fir, the first is a sound that would come off in that room, there ' 1 is a prerecorded message that tells the people in that room whether to stay in the room, remain there, so it is it is a done in sort of a tone, that doesn't cause people to panic, it tells them what to do. It's it then also on each floor there, there is a monitoring screen back over in the in an office not outside of the guest house, but actually has a screen, and I maybe can just pass this around .though, so you all can be looking at it while I am telling you about it, because it is a where the Fire Marshal sometime when they get on the scene that they can actually look at this system and it isolates the fire, it tells them where the fire is, how far it is, what it is spreading, then the Fire Marshal can actually get on this system and speak to the people in the rooms, in other words he can actually get on and then tell them whether to stay in the room or to if you are on the fifth floor go you are free to go ahead and leave or to stay in your room, if the fire is to stay or would be contained on that floor he would probably tell you to stay in there, but he has total control in communication with each guest in Page 4 iw — VA-83-66 River Heights Hotel, Inc. September 13, 1983 Mr. Wood: the hotel in that room. So this is a system, this is not required, this is not something that was required of us to do as well as the sprinkler system was not required. It was not a requirement to build this building. So we feel like we have, ah, gone beyond the, the scope of what is called for. So there are telephone jacks on each floor where there can be a command post set up with the Fire Marshal to guide the fire fighters on each floor to tell them what to do. We have three, three jacks on each floor, where they carry the portable phone in their hand and all they have to do is put it in the wall and the Fire Marshal can direct while he has a screen there showing which fire is going off in which room. He can direct the fire fighters on each floor. The, ah, when the fire goes off the elevators are automatically recalled and go to the ground floor and will not then move except by override by the Fire Marshal, and there again that is on, that is run by generators so even if the power goes out to the building the elevators, nobody can get trapped in the elevator, the elevators are automatically recalled at that point if somebody is in it, it goes to the first floor and the doors open and then can only be activated by the Fire Marshal, if they intend to use them then to fight the fire, and there, there again that is by generator so we feel like we have the, the latest in safety. (Inaudible) Mr. Smith: I would like to interrupt you at this point, what is the proposed top portion of that, that you are asking for the variance for, the use for it, is that going to be rooms also for rent? Mr. Wood: No, it is primarily where its going to be sales force, marketing, in house personnel for the, for the operation. There will be one suite that is there that will probably be on what's in industry today, it has gotten very compet- itive to the trade associations, they usually use a comp, a little a fancier suite you know like a penthouse suite so it would only be one suite that is not marketed to the public, but the majority of this will be office space for the operation of the hotel. We, ah, what we ended up having on the first floor we did not have a little sundry shop, ah, toothpaste, this type of thing so when you go into a hotel, whatever you got (Inaudible) converted space there to do that with so, therefore, we would be using this space now for that, and we will have marketing and sales a and and corporate offices on the top floor. It is not outside use, it is not for any outside function or lease or any other individuals outside of the hotel operation. It is an internal. Mr. Roberson: You say it is less than 4,000 square feet? Mr. Wood: Yes, sir. No, 4,700 square feet, what we are actually one-third of that, of the square footage of that floor. Mr. Smith: Will that be the same type of construction, or? Mr. Wood: Same, same construction, all the the fire and safety equipment will be taken up, every part, every part of it will be incorporated into that next side. It will be sprinkled, it will have the same system all the way through. Ah, ah, Mr. Walls from R.E. Lee is here to answer any questions you may have, and Mr. Lentz, the electrical contractor is Mr. Lentz, the electricalcontractor is *AmyTIMM Page 5 . VA-83-66 River Heights Hotel, Inc. September 13, 1983 Mr. Wood: here if you have any technical questions that you may like to ask them. If you have any other questions, I would be happy to try to answer them. (Inaudible) Mr. Smith: Mr. Wood, I have a questions for you, how does this present any hard-hip to you? Mr. Wood: Well, to the fact that it has become very competitive in the industr and this is something that we have only found out since we, we have a marketing a force on that to attract we can we now can hold the wa , we up to 1,200 people in a convention. To attract this type of convention to Charlottesville it is a very competitive business, mos of the people that you deal with in this end, ah, they have been, the expect certain things and in this case they expect the pomp suite, they expect to be treated ah, as in, as in the business that is how i is done, and in this case now we did not have a facility like that and the, ah, the other side of it being the fact that we did not have a sundry shop on the first floor and by putting that in that is taking up our our, our space requirements on that floor for marketing field personnel, which in this case we will have seven marketing people that will be marketing this property. So, from acompetitive, ah, side of it I believe is where it would be as opposed as to having to come back and relocate it off premises, in other words, have to locate this facility ' this this type thing and I think it would be inconvenient to have to locate it off the the existing site. Mr. Kennedy: There is no problem with, ah, area or topographic problem of locating something of that type there, an addition to the building or 100 feet away or 50 feet away? Mr. Wood: Well, other than we don't have it physically on the on the site to do it with the, ah, with the way we have laid out the site and is if you have been by there we have saved as many trees as we as we could, we have worked around it and by keeping the trees that we have, we have eaten up a lot of parking spaces where if we had just totally - Mr. Kennedy: Your sign, you site plan is all built up and you have your parking and your trees, and, Mr. Wood: Right. Mr. Kennedy: And you just want to go up rather than disrupt that? Mr. Wood: Exactly, and like I say we are approximately going up only the, ah, what as what you see there on the top floor. So, (cough) and from 29 again let me reiterate it is not, ah, visibly so, and I don't believe anybody, in fact, right now a lot of people you go out on 29 and you really don't see that much of it. (Inaudible) Mr. Smith: No, I I can't believe it is seven stories there. (Inaudible) Now Nompo Page 6 VA-83-66 River Heights Hotel, Inc. September 13, 1983 Mr. Wood: That's what, that's what I, that's what I mean, it's ai in fact we were we were building, putting the fifth floor on and people were still asking us when we were going to break ground. (Inaudible) Mr. Smith: What I am getting at, in order for this board to grant you a variance, I we suppose to well some kind of hardship - Mr. Wood: Right, and the the hardship being here to main- what, what type what we are trying to do in Albemarle County is to make this is to be in a competitive edge is just something that we were not aware of, ah, until we had gotten into it and had and had put our marketing people in and found out when you are talking to the trade associations, it whether we like it or not it's a that's what they look for, they want to know what's where do they, when they stay where do they stay if they are bringing in 300 rooms, what do they? Mr. Smith: Are you going to furnish the ordinaries and all in that suite I supp•s -. Laughter) Mr. Kennedy: O.K., anybody, any other questions for Mr. Wood? Do we have anybody else that is here to speak (Inaudible) Mr. Smith: I have a question of Mr. a Faulkner, (Inaudible) , how is this going to alter the site plan parking and so forth? Won't he have to add parking, won't he have to redo the site plan for 4,000 what square feet? Mr. Hurt: It has to be altered on the site plan, yes, sir. Mr. Kennedy: No surplus existing now? Mr. Wood: No, we, we have a joint a site plan with just to the immediate south or this is a office building of 120,000 square feet. We, ah, under the requirement we have joint parking with it being two different operations, the office building being primarily day time, there is bleed over parking, unless it is an office building pri- pretty much leaves at five o'clock you would have parking that would park, it is contiguous parking, the, the customer will not know the difference between the office building parking lot and the, ah, hotel parking lot. Mr. Kennedy: I guess his questions is if this variance were granted would you have to go back and get your site plan reapproved because it it might add space (Inaudible) that might require a different type of parking because of the type of use. Mr. Wood: I, I don't believe so, ah, Mr. Vaughn could probably speak to that because we are not, we are not talking about putting any additional square footage of of personnel, ah, in other words there would not be outside personnel, there would be the same existing personnel they would be relocated in the building, and the space that is being utilized, ah, in this case being the the sundry type shop, ah, I don't believe there will be outside customers that will come in and pick up a news- paper and or a gift, it is for hotel guest personnel and I don't, it is not marketing to the general public. Page 7 . VA-83-66 River Heights Hotel, Inc. September 13, 1983 Mr. Kennedy: That is what you had in mind wasn't it now? Mr. Smith: Ah, that's what I had in mind, but I have to disagree with Mr. Wood and if Mr. Vaughn rules on it I I think it would require additional parking with an addition of a reviewof the site plan, ah. Mr. Vaughn: Ah, Vaughn, I have not ruled, ah, on it, I have not been asked to, but I have examined it. Our parking requirements for the complex dealt with the hotels and motels which require one space per per unit, unit under the ordinance and we, ah, required additional spaces, ah, as required for the seating capacity of the restaurant, ah, the assembly rooms, convention center, ah, as provided in the ordinance. Now for administrative offices, ah, for the operation of the motel or hotel, we do not make any, ah, requirements because normally I think the rationale the planning there in writing the ordinance your administra tive offices are open during the day light hours or day time hours an your and all of these thousands of hundreds of spaces for your motel guests or hotel guests are required in the evening hours. I, I feel that is why the ordinance deals with it the way they do and the same way with convention attendance, ah, we provided space for the convention center this could be a day time or night time so we dealt with it separately, where as the office, ah, custodial staff, ah, a hotel tha size will have a large staff. They will normally use the same parkin places that the guests will be using. Ah, to clarify the a or just forlour information on what the state building code calls this. They call it a penthouse provided that it does not occupy more than 33 1/3 percent of the roof area, and this doesrnt. In a penthouse under the State Uniform Building Code is counted as the as part of the story below. So under the Uniform Building Code we don't call this an additional story, we call it a penthouse. But under the Zoning Ordinance we have a height in limitation, not story limitation. Ah. Mr. Van Fossen: Before you leave there Mr. Vaughn, could I ask you, what was the rationale behind the 65 feet as opposed to 55 feet or 75 feet, do you know? Mr. Vaughn: O.K., ah. (Inaudible) Mr. Vaughn: The, anything over 35 feet, ah, must be fire safe, now under the. Uniform Building Code dealing with fire safety under, ah, (inaudible) type 1 construction which this is, he could go 100 stories, it is unlimited area each floor is an indemnity in itself, its fire stopped at each floor. Your, your 30 guests would have 2 ways out of each floor. The floors are two-hour rated, so it doesn't matter whether it is 100 stories or 9 stories in this case where the guests will be are going to be. Ah, the contention of the model building codes, you are just as safe on the hundredth floor as you are on the first. And in a 100 building of fire proof construction and sprinklered is just as safe as a 1 story frame motel. So I keep that in mind if you ever stop in a motel and it is wood, you are just as safe in the a - Mr. Smith: You got to quit referring to this as a motel. It is really a hotel. Page 8 vise VA-83-66 River Heights Hotel, Inc. September 13, 1983 Mr. Vaughn: O.K. Hotel, motel. (Laughter) Ah, so rather it be nine stores of guests (Inaudible) or ninety, both are just as safe under the Uniform Building Code. Inaudible Mr. Van Fossen: I don't think you answered my question, do you know what was the rationale set in that the building code of height at sixty-five feet rather than seventy-five or fifty-five. Inaudible Mr. Kennedy: Was he talking about the Zoning Ordinance? Mr. Vaughn: The height, ah, the limitation of sixty-five feet, ah, I, ah, talkin. with Mr. Tucker, a a lot of it to do has to do with the aesthetics o; Albemarle County. Ah, the second consideration at some where back i time, like this building does not have to be sprinklered, it is sprinklered, it is compartmentalized really on each floor under the code, this type one construction. Ah, sixty-five feet, I like to feel it was chosen for aesthetics, ah, the only time you get into fire, ah, approval is if it is over thirty-five feet. We have to determine that it is safe to be over thirty-five feet. So the sixty-five feet, ah, would be a more in keeping with the aesthetics of Albemarle County. I don't believe that Albemarle County wishes a 100 story building. Mr. Kennedy: So you just think that was a arbitrary a selection, sixty-five feet, it could have very well have been seventy or sixty-three or sixty-on . Mr. Vaughn: I, I would say yes based on the fact that the ordinance allows twentI percent increase over that sixty-five feet for penthouses provided this is under Section a 4.10.3.2, Height Exception - Penthouses may be erected on a building to a height of twenty percent greater than allowed by the district in which a located provided that it is not used for sleeping, commercial or industrial purposes and access by the general public is expressingly prohibited. Mr. Smith: Then why, (Inaudible) , then why does he need a variance then? (Inaudible) Mr. Vaughn: I feel that. Mr. Smith: If he was in the ordinance. Ah- Mr. Kennedy: What would a penthouse be used for if it wouldn't be used for those things that you just read? Mr. Vaughn: Ah, Mr. Kennedy: Storage. Mr. Vaughn: Now I can see, ah, ah. . r.r r✓ Page 9 VA-83-66 River Heights Hotel, Inc. September 13, 1983 Mr, Payne: It is for mechanical places and things like that where Mr. Kennedy: Mechanical Mr. Payne: People don't go in them unless they are servicing the elevators ad ■+ - kind of thing. Inaudible. Oh, so he is allowed, ah, what thirteen feet. Inaudible, Mr. Van Fossen: I assume that is what he has, the brick structure comes out further. Mr. Payne: That is right, that is why that extends above the roof. Mr. Kennedy: So the, ah, yet they call it a penthouse in the ordinance. Mr. Payne: No, that is not a penthouse. Mr. Kennedy: Yet they call it a thing that is allowed twenty percent increase- Inaudible - they call that red is a penthouse. The same thing in the BOCA Code, you call it a penthouse. Inaudible. Mr. Smith: Inaudible - put a smoke stack up. Mr. Vaughn: The BOCA Code would call it a penthouse as long as it does not a exceed one-third of the floor area and becomes a as part of the story below, and the Zoning Ordinance, ah, does not give a definition for penthouse but under a the height exception of 4.10. Mr. Kennedy: o I stand correcting, I thoughtyou said the somethingabout the Y Bob,, g u h Zoning Ordinance and a penthouse? Mr. Payne: It uses the word (inaudible) penthouse, but it also has a provision that it expressingly excludes any in sleeping, housekeeping, or commercial or industrial use. I think it is clearly for purposes of the kind of service things that Mr. Wood was talking about, the elevator shafts possibly storage and mechanical spaces, that kind of thing. Mr. Kennedy: So there is no relation between the use of the word penthouse in the ordinance and (Inaudible) Mr. Payne: I don't think this falls under the this what Mr. Wood is proposing falls under that section clearly because the there clearly is a sleeping space as he described it. Inaudible. Mr. Vaughn: (Inaudible) I feel there are several offices would be open to the general public, also, and what I was trying to clarify that sixty-five foot limitation, ah, they allowed a twenty percent increase for a various uses, so I was saying that they were trying to keep the, ah (inaudible) aesthetics in low, low profile. S_eptemhar 13, 1983 Mr. Van Fossen: The terrain that we have in Albemarle County you could have a sixty-five story building in a valley you wouldn't see but the top two stories, but you could put a two story building on top of a hill and you would see the whole thing, so I really don't follow that reasoning. Mr. Vaughn: I, I do not know the rationale of the a of the purpose of that, the intent. Mr. Roberson: Is the brick part constructed already? The shade there Mr. Vaughn: The tower, yes sir. (Inaudible) Mr. Roberson: Well, isn't that about twelve stories tall? Mr. Vaughn: Yes, sir. Mr. Roberson: Well, how was it approved? Mr. Vaughn: That is permitted, that is the exception of twenty percent increase, that is not the public, that is the enclosed stairway and the elevator shaft. Mr. Roberson: This is what you just described in the (Inaudible) Mr. Vaughn: Yes, sir. That is permitted a and machinery and ventilating equipment, we have a positive ventilation on each hallway there, we have a ventilation on the a stair towers. All that equipment is up on that- Mr. Roberson: So he has already got the height actually? Mr. Vaughn: Oh yes, this will be actually lower (Inaudible) than the tower. Ah. Mr. Wood: It will be roughly eight feet, I believe, lower than the brick structur . In other words, the tenth, what we are referring to here is the tenth floor would be ten feet below the penthouse structure. Mr. Vaughn: The ordinance is written, I feel he needs a variance. It can not be permitted without a variance. Mr. Wood: To locate it, if I may, we we took a lot of this into consideration when we located the property, the hotel on the site as opposed to locating it out close to 29. We did this for the aesthetics of it just as you mentioned, if we had put the building out close to 29 with the parking in back of it, of course, it would have been more visibly a from 29, but right now its a its a from 29 you will only see approxi- mately five stories, four, and five stories from most of the eye view that we have from a a a exactly in front of it as you pass say from Real Estate III to the river you will only see two floors, and once you go across the river and come into town you don't see it at all in vision because the bank as you come across the bridge the immediate bank on your right you can not see the structure whatsoever from the north bound lane coming and turning in bound. Alright, anybody else here that wants to comment? Mr. Roberson: This gentleman has something else. Inaudible. Mr. Cortez: Good afternoon, gentlemen, I am Ira Cortez. I am the County Fire Prevention Officer. I heard somebody ask a few minutes ago about where this arbitrary figure of sixty or sixty-five feet came from. It is a for real figure. Hum. The National Fire Protection Associat •n considers any building over six feet or over six stories to have a a particular problem with smoke movement. In a building that is sixty feet or more, and this sixty-five feet is just five, five foot variance on the on the original sixty feet. Smoke can do very strange things. There is what is in a in a building called a neutral plain. When you deal with a building that is six stories or more, we have to take into consideration everything from the wind effect to the stack effe t that occurs inside the stairway of a building that may have a fire in one of the rooms or anywhere else. The smoke depending on the outside temperature, the air-conditioning operation, the wind on the exterior of the building, the smoke may in fact travel down the stairways inst- of up the stairways. Another consideration dealing with buildings ov- six stories is not so much as Chief Carter had indicated that there i- an evacuation problem, the aerial equipment would not be able to do that. Cough. Because once we pass the sixth story and it becomes a high rise building it becomes one of the three buildings where the people stay in place during the fire. As Mr. Wood had indicated he fully sprinklered his building, he gave us excellent, excellent fire protection for stand pipes on each floor, we have, ah, ah, emergency ventilation systems, we have generators, we have elevators, we have a 1 of those things, but the one thing that we don't have,is that if we d have a room fire the fire fighters have to get from the lowest level or the fire department access level, which in front of the building i on the second, really the third floor, to the sixth floor, with the standard equipment that they carry, their breathing apparatus is a demand type breathing apparatus, for them to haul two links of 2 1/2 inch fire hose plus their backpack plus their emergency access gear up six stories, they only have fifteen minutes of air left in their breathing apparatus. That is enough time for them to get back down the stairs because they are not going to operate in that atmosphere. There has never been a mutiple loss of life in a fully sprinklered building, never. Fully sprinklered, fully engineered, properly engineered, and properly maintained. Our problem or the fire service problem is that, unfortunately, people are people, accidents happen vaults get turned off, alarm systems are secured, emergency generators don't work, doors are left open. Whatever the case may be there is always the possibility that fire will in fact progress rapidly enough so the people are going to have to be evacuated off the upper stories of that floor or up the upper stories of that building. By adding this one penthouse does not necessarily endanger that large number of people, nobody is going to be sleeping up there or it is not going to be an apartment type or a sleeping place. It is not so much the danger , of those people that occupy it, but the fact that we have added anode$' story or this penthouse height, (inaudible) , which is going to increase 'saw Now Page 12 VA-83-66 River Heights Hotel, Inc. September 13, 1983 Mr. Cortez: the stack effect that is going to make that fire more unpredictable than what it already is. We have already exceeded the six stories because of the two stories below grade. If the fire started in fact on the lowest level and progressed up to the ninth story, we would in fact have a high rise, as a matter of fact the only thing that stops 1 this building from being a high rise is the fact that there is no fire department access on the rear end of the building. The building code requires that where ever the lowest fire department access is you measure from there to the top of the building and now you measure seventy-five feet and that becomes a high rise. So we far exceeded and the only reason that we are not a high rise is because of the semantics the semantics are that we didn't put a fire lane in th back of the building so therefore we are not a high rise. But, again I have to compliment Mr. Wood because he has in fact, building the building as a high rise, but we still don't have an access. So my point is if we add to the already high building, I won't call it a high rise, I will call it a tall building, we are going to increase the stack effect and we are not going to have the predictability that we should have. The second thing is it means reoutfitting eveiy fire fighter that goes into that building to fight a fire. Now these high rise packs are available at the cost of a thousand dollars per man, now we are dealing with a volunteer fire (end of tape) provide this additional nine thousand dollars, which I, I thought somebody from Seminole Trail would be here to address it, ah, but it is an addition 1 expense for the volunteer authorities to have to go through simply because we have now made it a high rise. That is all that I have to say. Mr. Smith: Mr. Cortez, due to the fact of the, ah, that you would have entrances from the top of this building down Mr. Cortez: Sir? Mr. Smith: There would be an entrance from the top of this building down, down a well as up, I mean your ladders, your ladders (Inaudible) you put a man on that a top floor. Ah. Mr. Cortez: Well, I am not even considering ladders, the accessibility of the evacuation of people in a building like this is very, very difficult. If a fire occurs in this building, first of all the egress width of a building like this, as I said, you defend a fire like that in place. There is a two-hour fire ratings between each floor, when afire alarm is actually pulled in a high rise building, I will give you a typical example, a 50, 50 story building takes 240 minutes to evacuate, it is virtually impossible. Consequently, when a high rise package is developed the alarms go off two floors above the fire floor, the fire floor itself, and one floor below, so at any given time we only have four floors of people evacuating and that's what the egress width is considered, only to be able to carry that amount of load, so we don't evacuate the whole building. Again, if the sprinkler system is functional and if it was properly designed 95 percent of the fire is being controlled with one sprinkler head and it generates. very little ; smoke. September 13, 1983 Mr. Cortez: whether it be a flammable liquid that was intentionally poured on the floor and it over burdens the system or somebody closed the valve. We'll have that problem and the problem is that the fire fighters can't get to the people because they have run out of air, because of this particular type of high rise pack and the chimney effect. Mr. Van Fossen: Mr. Cortez Mr. Cortez: Yes, sir. Mr. Van Fossen: Is the chimney effect already there though with the height of the elevators and the stair wells are the same that is not going to chang, . Mr. Cortez: No, we are increasing it eight feet on the north end. Mr. Van Fossen: You are increasing the the the brick structure Mr. Cortez: Yes. Mr. Van Fossen: where the elevator shafts and all are? Mr. Cortez: There is not going to be an opening up there. The shaft itself is supposed to be secured and, ah, the floor above and it will be fire stopped. In other words there won't be another door going to a place It won't be going to where the penthouse is, because the penthouse won't be there, it will be enclosed. Mr. Kennedy: Are you saying that a brick structure would be less in height because you wouldn't have a penthouse to require an elevator to go to the penthouse, so it would be cut off maybe about at the top of the penthouse? Mr. Cortez: I don't know, I don't know, I assume that is where it is going to be fire stopped. Inaudible. Mr. Walls: I am Ernie Walls with, ah, R.E. Lee. Mr. Kennedy: Yea. Mr. Walls: Ah, the tower which houses two passenger elevators, a service elevator, and a stairwell tower presently goes, without the penthouse, (inaudible) , the stairway goes up to the roof level and exits exit the stairway on the roof, you get on the roof by going up the stair tower, walk from the stairway down. With the additional penthouse on it, this stairway will go up one more flight, another eight feet, and exit on top of the penthouse. You will also be able to exit from the penthouse through doors on the back side onto the present roof or vice versa back into the building. Mr. Wood: Let me point out to you, I think your question or somebody's question was about this structure going up any more, here, this this is in right now, this is the height of it, so that, that will be Mr. Kennedy: About four feet, five feet. Mr. Smith: Eight feet. Mr. Wood: No. Inaudible. Inaudible. Mr. Kennedy: Well for whatever it is worth you were talking about a stack effect or something like that or we were just questioning whether the addition of the penthouse would require any additional (Inaudible) fire well and elevator structure. Mr. Walls: We're, we're looking at a from the roof line to this roof line about 12 1/2 feet. These other typical floors, the fourth floor is 8 foot 8, but from this roof to this roof there, would be, ah, about 12 1/2 feet. The tower over here that houses the elevators and the stairway would increase by the 8 foot 8 increment, though, we would not have t go the full 12 1/2 feet, so the this portion would basically be four to five feet higher than it a presently calls for in the design. Let me just show, show you a floor plan and you can see this. A, you are looking at this view, looking at this direction this is the face of the elevator tower you are looking at, there are two elevators here, staff tower, ah, a service elevator, the service elevator will not go to the penthouse, only the passenger elevators would. But this is th=, and this core core is is this area, ah, in red. Mr. Kennedy: What, ah, what is, point us the sides of the building. Mr. Walls: The sides of the building. Mr. Kennedy: Uh ha. Mr. Walls: Here is the, here is the (Inaudible) Mr. Kennedy: Just a narrow addition, what will the penthouse come a clear across, the top (Inaudiblel Mr. Walls: Right here. Inaudible Mr. Walls: I would point out one other item, (Inaudible) , and it is to maintain the aesthetics of this addition, this the roof line is about, ah, 2 1 2 feet below, this ia a parapet wall that goes all the way around the roof, a 2 1/2 to 3 feet in a height. We are reducing or proposing to reduce this parapet line some. (Inaudible while trying to keep drawing attached to wall) Mr. Roberson: I would go ahead and take it down. I don't believe its going to stay, Inaudible Mr. Walls: What we are looking to do where my point was is that this (Inaudible) this line is looking, the height is a is here is being reduced some six inches, ah, to keep these (Inaudible) the same through here and to hold, to hold the height on this as low as possible. Mr. Wood: This is also the actual effect, I had the the artist go out and actually get the actual effect of the height of these trees in relation to this portion of the building. So the the tree level here is actually 20 to 30 feet bearings of white oaks, higher than the structure that will not be changed roughly two-thirds, and will continue to be higher than this structure is. September 13, 1983 Mr. Walls: The, the existing construction up to now is that this is up to here, the ninth floor is on, the roof plank is on, this addition is not there, this elevator tower is up to this point here, up to right here (Inaudible) similar to like that. That is the present condition. Mr. Kennedy: Alright, thank-you. Mr. Smith: Mr. Chairman, I got a question Mr. Cortez (Inaudible) Mr. Kennedy: Alright, (Inaudible) Mr. Smith: What provisions in your opinion could be made to accommodate this ' situation, a fire lane in the back that says something about a. Mr. Cortez: I think it is impossible to put a fire lane back there because of the lay of the land. Ah. Inaudible. Mr. Cortez: Once we exceededfifty,once we exceed the sixty foot tall building, we start playing with the stack effect. We have already exceeded the sixty foot building now all we are doing is compounding it. Mr. Smith: Then he could cut his elevator off at the present level and walk to the next flight and he would comply to the aesthetics he was talking about, wouldn't he. Mr. Cortez: As I said, we have already exceeded the sixty feet, now we are compounding it, and the higher we compound it the more stack effect we have. Mr. Van Fossen: He is allowed to go sixty-five anyway. Inaudible. Mr. Smith: He's got that situation, I mean what I am thinking about is not makin• it any worse. I mean I know he don't want to walk that last flight of stairs, but(Inaudible) Mr. Cortez: (Laughter) That is not going to help either because the stairs would create the same effect that the elevator shaft will. Mr. Roberson: From the standpoint of fire safety hasn't he done everything reasonable? Mr. Cortez: Oh, yes, sir. Inaudible. Mr. Vaughn: Could I comment on that? (Inaudible) Under the state law this man has got to comply with the state building codes for fire safety. (Inaudible) I think the point made by the volunteer fire department is rightfully so, they do not have the equipment for walking if for some reason the elevators, which are reserved for Fire Department use only, they should be in inoperable. Those fire men would have sixty feet to go up or sixty- five feet to go up. The League of Women Voters believes that no structure should be allowed a height variance unless hardship can be shown. It is our understanding that the 65 foot height limitation was instituted for fire safety purposes. We wonder what plans the builder has for the safety of the occupants of the higher level. He is probably o.k. because he he is not too close to anything. Ah, yes I think you have the authority to grant this variance if you find the facts to exist and I think your, it is like any other case, the first thing you have to do is find as a matter of fact, and I think that of course you have been hearing me say this for years, you have to find as a matter of fact that a variance exists and you have to find that there is some peculiarity in the land or something like that that makes this unique, it is not shared by the properties in the in the area or that sort of thing. September 13, 1983 Mr. Roberson: Ah, that's that's what I am searching for, ah, we are not, we're this is not an appeal from the ruling of the Zoning Administrator. Mr. Roberson: Ah, and I can't find any, ah, any hardship here a (Inaudible) Mr. Payne: If there isn't hardship, then you don't grant the variance, it is as simple as that. One thing I would say is that is that I think Mr. Cort-z and Mrs. Jackson's comments are correct in my remembrance of where thi sixty-five foot limitation came from. I don't remember the exact, exactly what it was, but I do remember that when that sixty-five feet was developed it was because of of fire protection equipment and the idea was (Inaudible) Mr. Kennedy: Aesthetics, ah, was. Mr. Payne: Aesthetics I don't, I don't, I don't know if that was even discussed. What I remember being discussed was that, I think Mr. Cortez was at the Planning Commission meeting when it when it was discussed, and I think that was his recommendation for that. Mr. Bowerman: My name is Dave Bowerman and although I wasn't on the Commission in '79, the minutes of April 29, or April 23, 1979, ah, there are a couple items that are worth mentioning, a this is in regard to changing the zoning ordinance that was under review at that time. Colonel Washington then stated that in view of previous information with regard to fire fighting, the maximum height requirement should be lowered. Mr. Keeler said that the Fire Prevention Officer has reviewed the KDA graph and suggested 100 feet and had recommended that this be lowered to 65 feet. Doctor Moore then noted the limited amount of fire protection assistance, ah, over the (Inaudible) county. Mr. Kennedy: Well that gives us retrospective history, I guess.
