PROPOSED VARIANCE
The applicant requests relief from Section 10.4 of the Albemarle County
Zoning Ordinance to allow a parcel to be subdivided so that one parcel
of two acres would have 210 feet of road frontage leaving the remaining
acreage with 210 feet of road frontage; a variance of 40 feet for each.
ZONING ORDINANCE REQUIREMENT
Pursuant to Section 10.4, the minimum frontage required on an existing
public road shall be two-hundred fifty (250) feet.
STAFF RECOMMENDATION
We cannot make any recommendation. If the board should approve the variance,
it should be conditional upon Planning Commission approval.

Proposed Variance
The applicant requests relief from Section 10.4 of the Albemarle County Zoning
Ordinance to allow a single family dwelling to be located 63 feet from the
right-of-way; a variance of 12 feet.
Zoning Ordinance Requirement
Pursuant to Section 10.4, all structures shall be located a minimum of 75 feet
from a right-of-way.
Staff Comments
The topography of the two acre lot is approximately 20 degree slope gradually
increasing starting at about the 75 foot setback area.
The topography of the two acre lot is approximately a 15 degree slope at
the 75 foot setback gradually increasing from that point on the depth of
the lot to the creek. The construction of the house is taking place at the
present time.
