Boar's Head Inn, Inc. , owner (Amvest, Inc. , occupant) Tax Map: 59D(2) Parcel: 01-2 & 17 Zoned: HC w/SA Overlay District Existing Activity Vacant Proposed Variance The applicant requests relief from Section 30.5.2.2 of the Albemarle County Zoning Ordinance to allow a parking structure to be located within 103 feet of a SA (Scenic Areas) Overlay District (Highway Rt. 250W) ; a variance of 47 feet. Also, the applicant requests relief from Section 21.7.2 to allow off street parking to be located 10 feet from a residential district; a variance of 10 feet. Zoning Ordinance Requirement Pursuant to Section 30.5.2.2, SA-highway overlay districts are hereby established along the following highway corridors in Albemarle County for a distance of one hundred fifty (150) feet on each side of the right-of-way: (a) U.S. Route 250 from the western corporate limits of the City of Charlottesville to the western Albemarle County border. Pursuant to Section 21.7.2, adjacent to residential and agricultural districts: . no off street parking or loading space shall be located closer than twenty (20) , feet to any residential or agricultural district. Staff Comments The applicant proposes a parking structure which would encroach on the required scenic highway setback. The Zoning Ordinance provides an alternative allowed by Section 30.5.6.3.1, where as the Commission may reduce building setback to 75 feet from the scenic highway. (Section Copy Enclosed) This provision could be utilized on this site.
