Van Slyke Tax Map: 060A Parcel: 05-A8 Zoned: R-4 Existing Activity Single-Family Dwelling Proposed Variance The applicant requests relief from Section 6.5.01 of the Albemarle County Zoning Ordinance to allow an attached carport to be located 8 feet from the side property line, a variance of 2 feet. Zoning Ordinance Requirement Pursuant to Section 6.5.01, in the case of any subdivision which was approved pursuant to Chapter 18 of the County Code prior to the adoption of this ordinance and which was of record at the time of the adoption hereof, the rear, side and front yard and setback regulations of the Zoning Ordinance in effect at the time of such approval shall apply to all lots within such subdivision. Staff Comments The applicant wishes to construct a two-car carport. The adjoining lot's residence is located approximately 12 feet from the property line. The ordinance previous to December, 1980, the setback requirement is 10 ft. for side yard setback. The ordinance adopted December 10, 1980, amended January 1, 1983, provides for a 15 foot side yard with reduction to 10 ft. in accordance with Sect. 4. 11.3 (Copy Enclosed). The ordinance was amended to provide for fire protection between structures . We feel that the minimum 10 feet should be adhered to, or otherwise the purpose & intent of these amendments are defeated. As information to the Board, construction of a detached carport is presently under way.
