Pollock Tax Map: 059 Parcel: 59(part of) Zoned: RA, Rural Areas Existing Activity Vacant Land Proposed Variance The applicant requests relief from Section 10.4 of the Albemarle County Zoning Ordinance to allow a parcel to be subdivided with road frontage of 124.98 feet, a variance of 25.02 feet. Zoning Ordinance Requirement Pursuant to Section 10.4, the minimum frontage on internal public or private roads shall be 150 feet. Staff Comments: The applicant wishes to subdivide the 23.5 acre parcel, using the frontage existing on Windsor Road for the 3 acre parcel. This will aslo require Planning Commission approval of this subdivision. This lot would have entry onto Windsor Road (Farmington) . We feel that already having access to Windsor Road, the variance is warranted in that respect. The topography and narrowness of the private road, plus the road frontage site dis- tance, we feel warrants a limited access for this lot only. If the Board wishes to grant the variance, it should be for the establishment of a single lot at this frontage to serve this lot only of 3 acres, and Planning Commission approval of the subdivision plat. war +.r FARMINGTON PROPERTY OWNERS ASSOCIATION POST OFFICE BOX 5321 CHARLOTTESVILLE,VIRGINIA 22905 December 6 , 1983 To Interested Farmington Property Owners : In accordance with the recognized desires of the majority , of our membership, your Board of Directors of the Farmington Property Owners Association seeks to restrict traffic over Farmington' s private roads as much as is found possible . Your Board of Directors also recognizes rights and obligations contained in Farmington property deeds. When informed that the 23 . 5 acre tract purchased by Mr. and Mrs. Pollock from the Estate of Sarah Watts Miller was to be subdivided, your Board of Directors reviewed deeds in the chain of title and concluded that the portion of this property fronting on Windsor Road had no prohibition against subdivision after 1944 , that this property did not have customary Farmington covenants, and that this property had road frontage on Windsor Road with express access to Farmington' s private roads, water lines, electrical service , etc. Further, your Board recognized the possibility of some type of road „ w across this property that could permit unlimited traffic from Broomley Road to Windsor Road and to other private roads of Farmington. These circumstances prompted your Board and the Farmington Country Club to negotiate an agreement with the Pollocks whereby (1) Two, and ONLY two, lots can have access to Windsor Road and other Farmington roads, (2) the two lots having access to Farmington roads must become full members of the Farmington Property Owners Association, and (3) no road over the Pollock property can connect Broomley Road to Windsor Road so as to cause additional traffic over Farmington ' s private roads. The Pollock agreement was reviewed at the Annual Meeting of Farmington Property Owners Association on October 4 , 1983 , at which time a resolution was introduced, seconded and passed, approving of all actions taken by the Board of Directors during 1983. Pollock, husband and. wife, "Pollocks" , of the first part; Farmington Property Owners Association, Inc. , "Property Owners" , of the second part; and ! j Farmington Country Club, a Virginia non-stock corporation , 1 , "Farmington" , of the third part: Pollocks are the owners of a tract of land adjoining the Farmington subdivision containing 23 . 54 acres , more or less , shown and described on plat of R. 0. Snow & Associates , a copy of which is hereto attached as Exhibit A. From said plat it will be seen that this 23 . 54 acres lies between the "Durrette ' Road" and Windsor Road. From the aforementioned plat and examination of records in the Clerk' s Office of the Circuit Court of Albemarle County , it may be determined that that portion of the 23 . 54 acres lying to the west of the interior boundary line shown on the i plat and designated as "A" , is subject to restrictive covenants and conditions set forth in a certain deed recorded in D . B . 31J8 , p. 307 , with plat recorded at p. 309 . Property Owners are the successors in interest to enforcement of the restrictions and conditions set forth in the aforementionei deed recorded D.B. 208 , p. 307 . Under the terms of the deed recorded in D . B . 208 , p . 307 , and by virtue of subsequent conveyances (W. B. 39 , p . 235 ; D. B. 392 , p . 557 ; W.B. 54-114 ; D. B. 459 , p . 56 ) , Pollocks are precluded from effecting subdivision of the "A" portion of the rrr+ -2- 23 .54 acres, without first obtaining authority from Property Owners. From the aforementioned plat and examination of records of the Clerk' s Office of the Circuit Court of Albemarle County, it may be determined that that portion of the 23 . 54 acres lying to the east of the interior boundary line shown on the plat and designated as "B" is no longer subject to the restrictive covenants and conditions originally set forth in a certain deed recorded D.B. 234 , p. 441, with plat recorded at p. 443 . Under the terms of the deed recorded D.B. 234 , p . 441 , and by virtue of subsequent conveyances (W. B. 39 , p. 235 ; D . B . 392 , p. 557; D. B. 422, p. 382; W.B. 54-114 ; D.B. 459 , p. 56 ) Pollocks are not precluded from effecting further subdivision of the "B" . portion of the 23. 54 acres . The 23 . 54 acres owned by Pollocks has as appurtenant to the same under and by virtue of the aforementioned deeds recorded D.B. 208 , p. 307 and D. B. 234 , p. 441 , as well as other deeds contained in the chain of title thereto , the perpetual easements of right of way over the "Durrette Road" , a portion of which is shown on the plat attached hereto as Exhibit A. "Durrette Road" is a private road, also known as Broomley Road, and now owned by Thomas Worrell as successor in title to Farmington, Inc . The 23 . 54 acres owned by Pollocks also has as appurtenent to the same under and by virtue of the aforementioned deeds recorded D.B. 208 , p. 307 and D. B. 234 , p . 441 , as well as other deeds contained in the chain of title thereto , the perpetual -3- easements of right of way over Windsor Road and other roads within the Farmington subdivision. Windsor Road and the other roads in Farmington subdivision are private roads now owned by Farmington ; _ as successors in title to Farmington, Inc . (D.B. 666, p . 600) . The 23. 54 acres has as an additional appurtenance to it rights to sewage facilities within the Farmington subdivision and • the "B" portion of the 23 .54 acres has as appurtenant to it rights to connect to water and other utility lines within the Farmington subdivision (see D.B. 208 , p. 307 and D. B . 234 , p . 441 ) . Property Owners as successor to Farmington, Inc . (D . B . 673 , p. 340) has the right of enforcement of restrictive covenants precluding subdivision of the property lying to the north of the 23 . 54 acres designated as "Betty G . Weldon" on Exhibit A from subdivision into more than three parcels (see D . B . 208 , p. 307 , and D. B. 392 , p. 557) . Pollocks have indicated an intention to pursue subdivision of the "B" portion of their . 23 . 54 acres and have asserted their right to construct a road leading from the "Durrette" or Broomley! - - , Road to Windsor Road through the said 23 . 54 acres . Property Owners desire to place restrictions on the number of lots into which the "B" portion of said 23 . 54 acres may be divided . Property Owners and Farmington do not desire that a road be constructed from "Durrette" or Broomley Road connecting to Windsor Road. -5- 3. Pollocks for themselves and their successors in title do hereby agree that the "B" portion of the 23 . 54 acres shall not be subdivided into more than three parcels of land and that - only two of these three_ parcels shall be served by access to Windsor R:Jad and other roads in the Farmington subdivision, and by utilities owned or controlled by Farmington or Property Owners . Any plat of survey subdividing Parcel B and providing for an interior road shall bear the notation "this road shall not be extended to the Durrette , (Broomley) Road. " 4 . Farmington and Property Owners acknowledge that said two lots do and shall have the appurtenant rights to roads and utili- ties in Farmington subdivision as set forth in the deed recorded D.B. 234 , p. 441 . However, neither Farmington nor Property Owners shall be liable for : a. costs incident to utility service for such lots , or b. construction or maintenance costs incident to any road on said Parcel B. 5 . The Pollocks agree for themselves and their successors in title to the "B" portion of the 23 . 54 acres to be served by access to Windsor Road (2 parcels) that the restrictions and 23 , Block C, on plat D . B . 357 , p . 527 , agreements applicable to Lot / in the Farmington subdivision shall be equally applicable thereto and that the owners of such property (2 lots) shall become regular members of Property Owners . The restriction imposed hereby may be enforced by injunction or other equitable relief. In the event other legal proceedings are initiated to enforce such restrictive covenants , the sub- -6- stantially prevailir.: party shall recover from the other party or parties all costs, including reasonable attorney ' s fees . 6 . The Pollocks do further agree for themselves and their successors in title that the third lot formed by division of said "B" portion of the 23. 54 acres shall be served by access to the "Durrette" or Broomley Road only, and do hereby release any and all rights thereto in and to roads and utilities now or hereafter owned by Property Owners and/or Farmington within the Farmington subdivision. ‘C>°e \v`�J� 7 . Pollocks do further agree for themselves and their successors in title that no road nor any portion of such road shall be con- structed across the 23 . 54 acres connecting Windsor Road to the "Durrette" or Broomley Road. 8 . The parties agree for themselves and their successor in title to execute such additional and further instruments and deeds , if any, as may be required to effect the express purposes of this agreement. Sf...//t11 `I FROM:FROM: Concerned Farmington Property Owners RE: VA. - 83-79 DATE: December 7, 1983 We, the undersigned, as adjoining property-owners or other concerned property- owners in Farmington, wish to express our opposition to applicant's request for relief from Section 10.4 of the Albemarle County Zoning Ordinance for the following reasons: 1. A variance is not needed. Applicant has requested subdivision of only one parcel of land. The lot thus created would have access to Windsor Road over its own driveway. 2. Denial of the Bariance sought by the applicant would not cause undue hardship on applicant. Applicant already has access from his property via Broomley Road and. constructing a connecting road to Windsor Road is net essential to applicant's well being, to the enjoyment of his property, nor to any potential further subdivision of his property. 3. Granting a variance would establish an undesirable precedent. There are several other underdeveloped properties adjoining Farmington which, should the Board grant applicant's request, could request connecting roads to the Farmington Roads. This would resurrect the problem created in the matter of Thomas E. Worrell (ZMA-80-16) . The thrust of our successful argument therein centered on (1.) The inadequacy of the Farmington private roads to support any volume of traffic and; (2) that such access by adjoining developments would result in intolerable conditions affecting the welfare and safety of the community and would so disrupt the environment as to destroy the character of the Farmington residential area and the club itself.
