This was a scheduled workshop session of the Albemarle County
Planning Commission held on February 5, 1973 at 7:30 P. M. in the'
Board Room of the County Office Building.
Present were: Chairman Avery Catlin, Vice-Chairman M. Clifton
McClure, Mr. David W. Carr, Mr. Wilbur C. Tinsley, Mr. M. Jack
Rinehart, Mr. Louis C. Staley, Dr. James Sams , Mr. William S. Roudabush,
and Mrs. Ellen B. Craddock. Also in attendance was Mr. Gerald Fisher,
County Supervisor. Mr. Lloyd Wood, Supervisor, arrived later during
the meeting.
The meeting was called to order and a quorum established.
It was noted that item 4 on the agenda "Ednam Village" , would he
deferred until next Monday, February 12, because the applicant could
not be present at this time.
Item 5 on the agenda which read: "Proposal to appeal decision of
Board of Zoning Appeals regarding Holiday Inn Sign Variance", was
presented by Mr. Humphrey. Mr. Humphrey informed the Commissioners
that Holiday Inn which is located at interchange of Rt. 631 and I-64,
had been granted a variance by the Board of Zoning Appeals to allow their
sign to be 47 feet in height as compared to 30 feet required in the
ordinance, 400 sq. ft. in area, as compared to 100 sq. ft. in the
ordinance. Further, he stated that Holiday Inn desired flashing 1 -ghts ,
but the Board of Zoning Appeals restricted this.
Dr. Catlin informed the Commissioners that he had this put nn the
agenda because of the major difference in site that the B. of ::. A;
permitted than the Sign Ordinance permitted.
' Mr. Carr questioned the basis of the variance. Miss White, o the
Planning staff, said the only basis they had was that this sigh wa- a,

national trademark and recognized by most people.
Mr. Rinehart asked if the Planning Commission as a group had the
right to do anything about the decision of the B. of Z. A. . Mr.
Humphrey informed him that they could appeal the decision of the
Board of Zoning Appeals , but the proper thing to do would be to reque t
the Board of Supervisors to appeal it.
Mr. Roudabush, who is also a member of the Board of Zoning :\lleals,
said he did not know why the variance was granted and that he voted
against it since he could see no hardship involved. He further said
the owners admitted they had several different other signs they could
use.
Mr. McClure made a motion that the Board of Supervisors be re-
quested to appeal the decision of the Board of Zoning Appeals. Th.c
motion was seconded by Dr. Sams.
Mr. Carr wondered if the Commission desired to give the Board
of Supervisors any reasons for their decision. Mr. McClure was of the
opinion that the reasoning should come from the Planning Office. 1
Dr. Catlin instructed Mr. Humphrey to write up the reasons ant pre-
sent them to the Board.
The above motion carried unanimously.
Milton Hills Subdivision, Section II , Route 729.
Mr. Humphrey gave a short presentation of this subdivision, whici
had been deferred from the previous meeting. lie showed to the C emission
the roads that were requested to be restricted roads.
At this time Mr. Roudabush excused himself from the discussion ,nd
voting and requested the Chairman to wait until 8:00 to take up this

in aggregate area of freestanding sign, a variance of 215 square feet; and to
also allow 20 square feet additional wall sign, a variance of 220 square feet.
Zoning Ordinance Requirements
Pursuant to Section 4. 15.3. 7, Business Signs, Freestanding or Projecting:
Provided: (b) the aggregate area of such signs shall not exceed one hundred
(100) square feet; and (c) no portion of such sign shall be greater than
thirty (30) feet from ground level or the eave line of the roof of the main
building located on the premises upon which such sign is erected, whichever
is greater. Also, pursuant to Section 4. 15.3. 7, Business Sign, Wall:
Provided: (b) the aggregate area of all such signs shall not exceed two
hundred (200) square feet.
Staff Comments:
On January 30, 19-85, the Board of Zoning Appeals conducted a public hearing to
consider the request for variances involved: permitting the erection of a
free-standing sign 17 feet more than the maximum permitted. The maximum
permitted is 30 feet in height. The erection of their Holiday Inn (standard
sign) of 400 square feet in aggregate area, which involved 300 square feet
more than permitted by the Zoning Ordinance. The Board of Zoning Appeals
approved the requested variance beyond the maximum as stated above but did
not permit any flashing, blinking, or movement involving the sign.

The Board of Supervisors appealed the Board-of Zoning Appeals' decision to the
Circuit Court. Judge David Berry, on November 20, 1973, signed a final decree.
The court doth hereby reversed the decision of the Board of Zoning Appeals and
order that the variance sought be denied.
On November 13, 1979, the Board of Zoning approved a variance, VA-79-62, for
nineteen (19) square feet, which allowed a total of. 219 square feet of wall
signs. In view of the 1979 variance - the total wall sign existing at present
is 219 square feet. The variance for additional wall signage would have to be
re-advertised.
In regard to the freestanding sign the ordinance per Section 4. 15.3.7 - (C) , no
portion of such sign shall be greater than thirty (30) feet from ground level
or the eave line of the roof of the main building located on the premises upon
which such sign is erected, whichever is greater. (Submitted to you is a
drawing showing the relation of sign height to roof eave line.)
The applicant has four (4) identification signs located on Interstate Highway
64, one (1) freestanding business sign and wall signage. The applicant wishes
to increase the size of the existing freestanding sign, and erect a second
freestanding sign 62 square foot in size at their business entrance on 5th
Street. In review of the freestanding sign the topography adjacent to I-64
offers visible access but is minimal.
My opinion is that the highway signs serve the purpose of notification that
facilities are available at a prescribed exit. Traveling south on 5th Street
you are in visible contact with building and sign in adequate time to make an
exit to the site. In summary, I find no hardship, or uniqueness and cannot
recommend approval.
