Tacco, Inc. , Owner Lowe Mechanical, Inc., Applicant Tax Map: 045 Parcel: 25G Zoned: LI, Light Industry Existing Activity Contractor's Office Proposed Variance The applicant requests relief from Section 26.10.1 of the Albemarle County Zoning Ordinance to allow a freestanding sign to be located 4 feet from the right-of-way of Rio Road, a variance of 46 feet. Zoning Ordinance Requirement Pursuant to Section 26.10.1, Adjacent to public streets: No portion of any structure, except signs advertising sale or rental of the property, shall be erected closer than fifty (50) feet to any public street right- of-way. Staff Comments The applicant replaced a sign with a new sign (Lowe Mechanical) . The variance application was made to bring the replacement sign into compliance with setback requirements. If the applicant located the sign at the required setback, its visibility would be limited. To maintain the existing landscape (trees) , the applicant would not have full visibility of the sign. A hardship exists but to a limited degree. If the Board wishes to grant the variance, it should be under three (3) conditions: 1. Limited to the size as shown. 2. All trees within the 50 foot setback as required remain undisturbed. 3. Any future development of the road right-way, then the property owner would relocate the sign at the owner's expense. As this is a new erected sign it may not be considered as an existing non-conforming sign, and must therefore meet current zoning requirements of Albemarle County. Section 26.10.1 of the Albemarle County Zoning Ordinance requires a 50 foot setback. I understand from our conversation that you intend to apply for a 46 foot variance to leave the sign at its present location. Therefore, you should apply for a variance in our office by no later than October 31, 1983, so t. your variance can be heard at the November 15, 1983 meeting of the Board of Zoning Appeals.
