Sun Oil Co. , Owner Thomas Jones, Occupant Tax Map: 061W Parcel: 02-B3 Zoned: C-1 Existing Activity Gas Station Proposed Variance The applicant requests relief from Section 21.7.1 of the Albemarle County Zoning Ordinance to allow a structure (roof covering over gas pumps) to be located 8 feet from the highway right-of-way, a variance of 22 feet. Zoning Ordinance Requirement Pursuant to Section 21.7.1, adjacent to public streets: No portion of any structure except signs advertising sale or rental of the property shall be erected closer than thirty (30) feet to any public street right-of-way. Staff Comments The applicant proposes to construct a roof covering for the existing gas-pump islands. The road right-of-way (Route 29 North) veers inward on the south end of the property fronting on Route 29 North. This is not common place with other properties on the highway. The existing pump islands are within the required 30 feet setback (26.5 feet) . Other than a protective covering from weather conditions for customers we find no uniqueness of hardship existing. We feel the applicant should show more cause why the variance should be granted.
