Hutter Tax Map: 031 Parcel: 38 Zoned: Commercial, C-1 Existing Activity Storage Proposed Variances The applicant requests relief from Section 4.1.3 to establish two (2) commercial establishments on a 18,000 square foot lot, a variance of 102,000 square feet. The applicant requests relief from Section 21.7.1 to allow a commercial building to be adjacent to road right-of-way, a variance of 30 feet. Zoning Ordinance Requirements Pursuant to Section 4.1.3, for a parcel served by neither a central water supply nor a central sewer system, there shall be provided a minimum of sixty thousand (60,000) square feet per commercial or industrial establishment or per dwelling unit as the case may be. Pursuant to Section 21.7.1, Adjacent to public streets: No portion of any structure except signs advertising sale or rental of the property shall be erected closer than 30 feet to any public street right-of-way. Off-street parking and loading space shall be located and/or screened so as to minimize visual impact from public streets. No off-street parking or loading space shall be located closer than ten (10) feet to any public street right-of-way. Staff Comments: As past history, the Board of Zoning Appeals granted a setback variance in 1974, for the location of a refrigeration unit to be located 12 feet from a road right- of-way in connection with the store. The existing business establishment is a country store. (Not open at present) The establishment of a barber shop is proposed for the second use. Approximately 150 square feet of an accessory storage building to the rear of the store structure will house the barber shop. The business is served by a private well and septic system. I feel that if the Board wishes to consider the variance that it be subject to the following: 1. Approval from the Health Department that both water and septic is adequate to accommodate such use. Variance be granted to said occupant for this use only. 4. Applicant is subject to fire regulations in accordance with Table 502 Fire Grading of Use Groups of the BOCA Uniform Statewide Building Code for building separations. VA 83 - 87 Gleco Mills Inc . We do not believe this application is properly before you, as no specific variance has been applied for, nor advertised. If however the Board of Zoning Appeals decides it can consider the application and take action, we ask that the petition either be denied or considerably limited. It must be recognized that some properties are self- limited because of size , location , terrain and existing on-site devel- opment. It is not the County' s responsibility to provide re- lief for self-imposed, purely speculative "hardship . " The area requirements from which the variance is sought have been a part of County ordinances since 1974 , first as part of the Subdivision Ordinance , then added to the Zoning Ordinance in 1978 upon recommendation of the local health department in each case . These recommendations mainly considered residential development , but commercial and industrial development has been limited in the past by actions of the Board of Supervisors which upheld these requirements . The League has supported these deci- sions as they have served to channel intense growth into areas recommended by the Comprehensive Plan. No public sewer line is contemplated in the Route 29 South area in the foreseeable future and there would be little control over effluent from a variety of allowable uses under the proposed L1 zoning . We see no reason to further compromise the public health , safety and welfare provisions of the Zoning Ordinance by allowing more intense usage of this area-deficient property than the established regulations allow. or 24Eh`J�E 0 -2- Albemarle Co. Board of Zoning Appeals December 12 , 1983 Should the Board of Zoning Appeals determine that only non- effluent-producing uses such as storage would be appropriate in this case , in order to make a variance allowable , condi- tions should be imposed to enforce this determination, an action which the Board of Zoning Appeals is afforded by state statute . A 83 - 88 Chauncey F. Hutter We do not believe this application merits approval . The C-1 designation was given to this property when the zoning map was revised in 1980 , as it was located in the Earlysville village area and was an existing non-conforming commercial use . However, we believe this use should not be expanded by conversion of an existing storage building to additional commercial activity on an area- deficient lot . Commercial use is being made of the property ; the applicant desires a more intensive use which could barely be realized if the lot were undeveloped and the area requirements inapplicable . Should the variance be granted, the building intended for storage could be used for purposes other than a barbershop , to the detriment of the area in matters such as traffic generation, parking , etc . We can see no hardship in this matter, and ask for denial .
