Rinehart Construction Tax Map: 42 Parcel: 168 Zoned: Rural Areas, RA Existing Activity Single-Family Dwelling Proposed Variance The applicant requests relief from Section 10.4 of the Albemarle County Zoning Ordinance to allow a single-family dwelling to be located 84.94 feet from right-of-way, a variance of 5.06 feet. Zoning Ordinance Requirement Pursuant to Section 10.4, all structures shall be located seventy-five (75) fee, from the front property line. Staff Comments: This variance is in regard to a residence setback from a private road. A building setback line was indicated on the plat at 90 feet, which is measured from the center of the private road. A footing inspection was made on June 30, 1983, at the time the setback was checked. It was not until a survey was done for the house location that a violation existed. As you can see on the plat submitted, the front yard adjacent to the road is on a radius. These type of setbacks are hard to check unless they are done precisely. We have a house that is in violation of the setback requirement which you asked to grant a variance because of an error that was made. I find that the problem should not occur in the future if the contractor, or owner will provide the inspectors with set-irons and permanent markers to measure setbacks from; and the inspectors not approving any setbacks until they are absolutely sure of their findings.
