Roudabush, Inc. 914 Monticello Road Charlottesville, VA 22901 Re: Variance #VA-82-93 Dear Mr. Gale: On February 14, 1984, the Board of Zoning Appeals deferred your application VA-83-93 to the next regular meeting on March 13, 1984. A suggestion to the Board was made that the easement could be relocated to meet the required setback, which is sixty (60) feet. The relocation would not affect the use of the existing entry road, as long as it was within the thirty (30) foot easement. Upon redrawing the plat with the rear easement location, then it would most likely eliminate the need for the variance. If the relocation does not provide the required sixty (60) foot setback, the Board could again review the application at the March meeting. You may contact my office, if I may assist you in any way. Winston & Tommy Frye Tax Map: 101 Parcel: 25 Zoned: Rural Areas, RA Existing Activity Residential Proposed Variance The applicant requests relief from Section 10.4 of the Albemarle County Zoning Ordinance to allow the setback of a residence from a proposed access easement to be 40 ft. , a variance of 35 ft. Zoning Ordinance Requirement Pursuant to Section 10.4, all structures shall be located seventy-five (75) feet from the front property line. Staff Comments: The applicant is wishing to subdivide a 10 acre parcel into 2-5 ac. lots, thus creating an easement to serve the rear parcel. In review of the applicant's request, the easement provided for the rear lot creates another yard adjacent to the easement. For other yards adjacent to streets there shall be 80 percent of the front yard required thus 60 feet. The resident structure would be located 40 feet from the access easement, thus'. needing a 20 foot variance. I find that there is a possibility that the easement could be shifted and still maintain the use of the existing driveway on State Route 631. The easement can be placed so the structure will meet the setback required, but it should be so that if at all possible to maintain the exisiting entrance and driveway. The topography is such that the easement could be installed both at the proposed location, and at the required setback. I find that there is really no hardship and cannot make a favorable recommendation; $20.
