Atkins (or Josephine) Tax Map: 20 Parcel: 15A Zoned: Rural Areas, RA Existing Activity Vacant Land Proposed Variance The applicant requests relief from Section 10.4 of the Albemarle County Zoning Ordinance to allow an accessory structure to be located 35 ft. from the highway right-of-way, a variance of 40 ft. Zoning Ordinance Requirement Pursuant to Section 10.4, all structures shall be located seventy-five (75) feet from the front property line. Staff Comments: The applicant wishes to construct an accessory structure in connection with the proposed hydroelectric project. The project has an approved Special Use Permit #82-7. Accessory structures are permitted in the flood fringe per Section 30.3.5. 1.2 #2, provided that such structures be firmly anchored to prevent flotation, collapse on lateral movement due to flooding. In review of the property in regard to the application, we find limited area that is located outside the flood limits (100 yr.) . There is no area 75 feet from the road right-of-way that the structure can be located outside the flood area. Even though stated before accessory structures can be located in the flood fringe, I feel that it should not be located within if there is ample space,..thus the need for the variance. The structure will be located on property that is adjacent to the intersection of Rt. 641 and Rt. 743. At the setback asked for it should not be any detriment to any adjacent properties. Should future dedication of property for highway right-of-way be necessary, I would recommend if the Board wishes to grant the variance, it should be subject to no future expansion allowed that would encroach the road right-of-way. Elrod RE: Advance Mills Hydroelectric Project SP-82-7 DATE: March 10, 1983 1) The applicant, Mr. Atkins , as a professional engineer , has filed a report in which he states that his project will not • create any adverse effects concerning noise, electrical inter- ference, etc. He does not offer any actual manufactures data concerning performance standards because he has not yet selected the equipment that he intends to use. Since there is no engineer- ing data the Engineering Department cannot certify that the project will or will not meet the requirements of section 4 . 14 of the Zoning Ordinance. The only thing that we can suggest would be to allow the project to proceed with the understandin that if any 'violation occurs in the future the project will be shut down. 2) Mr. Atkins has obtained permits and/or letters of approval from the agencies listed below. The letter from the Commissio of Game and Inland Fisheries was not a direct approval , howeve , Mr. Atkins has 'o1utlined in his report and correspondence measures that will satisfy the Commission' s requirements . I do not know of any other federal or state agencies who would have jurisdiction over this project. The 'building,, will not affect the flood plain limits . 4) We have prepared the attached sketch to indicate our understanding of the grading that Mr. Atkins plans to do as a part of this project. We approve of the grading shown on the sketch and do not feel that it will affect the flood plain limits. 5) In summary, the Engineering Department approves of this plan, however, there are still parts of the ordinance which are yet to be satisfied (ie: the performance standards of section 4. 14 and the floation prevention requirements of section 30. 3. 3. 2 and the BOCA Code) .
