German (Brown) Thomas Leslie Harlow Tax Map/Parcel: 75 61 Acreage: 12 acres " Zoning: R--1 Location: On private right-of-way off of Rt. 702, 6/10 mile from the intersection with Rt. 29 South (old road) VARIANCE REQUEST The applicant requests relief from Section 13.3 of the Albemarle County Zoning Ordinance to allow an existing barn to be converted into a single-family residence and to be located 2.0 feet from the southwest corner of building; a variance of ', 13 feet from the side property line. AREA CHARACTERISTICS The (barn) structure is located on sloping property, which is joined by an 8 a : parcel with 6 duplex living units. There is a residence located on the other adjoining property. This adjoining properties have no public sewer or water. COMPREHENSIVE PLAN This area is designated for low/medium residential use, which is compatible to the proposed use. AGENCY COMMENTS The proposed use would be subject to Health Department, Virginia Department of Highways, Building Official and Fire Marshal approvals. STAFF COMMENTS The change of use from a barn (storage or accessory building) to a residence, thus makes the structure become the main building and use. This creates the requirement for yard setbacks. Any structure reducing the required yard setback diminishes adequate light, air and fire prevention which it provides. Structures located closer to the property line than required must be constructed in accordance with Table 502 Fire Grading of Use Groups of the Uniform Statewide Building Code. STAFF RECOMMENDATIONS Converting the structure to a residence makes it conforming to the residential zoning. The location of the structure being 2 feet from a side property line presents a problem. If a residence were located on the adjoining property at the 15 foot side yard setback, two (2) main structures would only have 17 feet of separation. STAFF REPORT - VA-84-01 CONTINUED Page 2 This situation would be mainly in conflict with adequate fire separation. The property has a total of twelve (12) acres, which provides for development of the property in a reasonable manner. The narrowness of the frontage part of the property does limit any placement of a residence, but in no way prohibits 1 jj, the use of the property.
