The applicant requests relief from Section 30.5.2.2 to allow a parking structure
to be located within 96 feet of a SA, Scenic Areas Overlay District of highway
Rt. 250 West, a variance of 54 feet.
Zoning Ordinance Requirements
Pursuant to Section 30.5.2.2, SA-highway overlay districts are hereby established
along the following highway corridors in Albemarle County for a distance of one
hundred fifty (150) feet on each side of the right-of-way:
(a) U.S. Route 250 from the western corporate limits of the City of
Charlottesville to the western Albemarle County border.
Staff Comments
The Board of Zoning Appeals approved a variance for setback of the parking
structure in October, 1983. A variance of 47 feet was granted allowing the
structure to be within 103 feet from the right-of-way of Rt. 250 west.
The applicant wishes to enlarge the parking structure which will encroach
on the setback by seven (7) additional feet.
It appears that only a front wall will be exposed as far as constructural
changes, thus matching the other side.
The following again are the comments from the previously granted variance,
VA-83-71. The ordinance provides an alternative allowed by Section 30.5.6.3. 1
where as the Commission may reduce building setback to 75 feet from the scenic
highway.
The variance asked for should not be of any adverse effect on the adjacent
property owners.

Dear Mr. Ancona:
This letter is to inform you that on February 14, 1984, during the
regular meeting of the Albemarle County Board of Zoning Appeals, your
application for VA-84-02 was approved. This variance approval allows
relief from Section 30.5.2.2 of the Albemarle County Zoning Ordinance
to allow a parking structure to be located within 96 feet of a SA, Scenic
Areas Overlay District of highway Rt. 250 west, a variance of 54 feet.
Pursuant to Section 35.0 of the Zoning Ordinance, the actual cost
of any notice required under the code shall be taxed to the applicant, to
the extent that the same shall exceed the applicable fee set forth in this
section. Failure to pay all applicable fees shall constitute grounds for
the denial of any application. Please see the at.:ached bill for the amount
due of $4.40.
