I I Tax Map: 78 Parcel: 81 Zoned: PRD Existing Activity it Single-Family Dwelling Proposed Variances The applicant requests relief from Section 19.9.2 of the Albemarle County Zoning Ordinance to allow a single-family residence to be located 46 feet from front property line, a variance of 4 feet. P Zoning Ordinance Requirements Pursuant to Section 19.9.2, within the PRD district, the board of supervisors shall establish minimum setback and yard requirements at time of establishment of such district. Staff Comments: The applicant is requesting a setback variance from the required approved subdi- vision. Ashcroft subdivision, Section I Phase 1 setbacks on lot 3,6,7,8, 25 & 26 are 30 feet and all other lots are 50 feet. This application is in regard to lot 2, which requires a 50 ft. setback. Enclosed please find a memo report to accompany the staff comments. I find that in reviewing all information no hardship exist for granting the variance, but the Board is placed in the position of allowing the variance because of circumstances pertaining to the application. As information to the Board, the zoning personnel will be instructed to only approve future footing and zoning inspections if the setbacks can be checked 4-1' curely in the field. The responsibility will be for the developer to check the setback requirements before calling for the inspection. Evans Deputy Zoning Administrator FROM: John Grady L 1 DATE February 10, 1984 ij RE: R. L. Beyers The first inspection was done on this lot on 11/30/83. The inspection was called in over the radio and as I was in the area could I stop to do the inspection because Mr. Cosner was worried about leaving the footing open over night because of threatening weather. I went to lot 2 Section I Ashcroft on my way back to the office and took the setback requirements and footing requirements over the radio.' . The front setback given to me over the radio were for 30' , which is correct for some lots in Section I of Ashcroft. The problem arises in that lot #2 had an exception clause that stated it should meet a 50' front setback that went un- noticed when it was called in. I do feel that the blame for this should be placd mostly with me for it is my responsibility as the inspector to secure the proper information myself before going to a job site. I first noticed a mistake may have occured on 12/20/83, when I was at Ashcroft doing another footing inspection on a different lot for Forloines Construction. At this point I noticed the 50' exception on the plat and proceeded to recheck my job. I felt that there may be a problem but because the property irons had different off-sets on each side of the road; I could not locate the property line without a survey being done. I notified Mr. Beyers on 12/21/83, that there may be a problem with the setback, and he agreed to have a physical survey done and forward a plat to our office. Mr. Beyers bought the plat to the office on 1/18/84, and this did show the house was located approximately 5' to close too the front setback. It should be noted that Mr. Beyers was very willing to work with our department and felt equally at blame for misreading the wrong setback requirements. One should understand that with the different off-set locations for irons and changing front setbacks in Ashcroft, it can be very easy to make a mistake in this subdivision. JG/mdv I' 1 11
