The applicant requests relief from Section 4. 1.6 of the Albemarle County Zonin;l,
Ordinance to allow for the location and area for the original septic disposal
field and 50 percent future replacement site, a variance of 50 percent future
drainfield area.
Zoning Ordinance Requirements
Pursuant to Section 4. 1.6, for lots not served by a central sewer system, rio
building permit shall be issued for any building or structure, the use of
which involves sewage disposal, without written approval from the local office '
of the Virginia Department of Health of the location and area for both origina
and future replacement septic disposal fields adequate to serve such use.
Staff Comments
The applicant has adequate area for the original and the future replacement septic
system. The Hunter's (lot 29) wish to sell .19 acres to the adjacent property
owner of lot 30, so that lot will have at least 50 percent future replacement area.
At present, the adjoining lot 30 has no suitable replacement area as reported by
the Health Department.
If lot 29 is allowed to divide off the .19 acres to give lot 30 so that it will then
have a 50 percent replacement area, then the Board would have to also grant a variance
to the owner of lot 30 for 50 percent of replacement area.
In review of the application, lot 29 has no hardship, but is creating the hardship
and the need for the variance by reducing its replacement area to give additional
area to lot 30. Also, lot 30 will still require a variance because of it only having
a 50 percent replacement area.
Our recommendation to the Board is that the variance should not be granted unless it
receives written support from the Health Department that there would be suitable soil
and area to protect against future problems if they occur.

Dear Mr. Evans:
As requested I am writing you regarding the variance
to the above referenced property, As request with regard
you are aware, this department has made
a number of visits to this lot and the adjoining lot (Lot 30). A septic tank
permit has boon issued to Mr. Hunter for Lot 29 and precisely indicates the
exact location for the installation of a septic system. Any change will in-
validate this permit.
Please understand also, that this department cannot recconmend the pro-
posed division of Lot 29 to be added to Lot 30. By doing so it will mean
that the reserved area for Mr. Hunter will be reduced from the 100% as re-
quired to 50%. Based upon soil conditions of the area, it is our opinion
that a 100% backup site should be required.
As far as Lot 30 is concerned, the proposed addition of property from
Lot 29 will at best afford only one drainfield site, which itself is very
questionable as to its suitability for drainfield, and there will be no
reserve area at all.
Should you require any futher information at all, please contact me
at the Thomas Jefferson Health Department.
