Staff has reviewed your initial submittal for a special use permit regarding the Virginia Institute of Autism
(VIA) Adult Service Center (SP2019-04). I have organized the comments that relate to the special use and
site plan, separately. We would be glad to meet with you to discuss these comments if you have questions.
SPECIAL USE PERMIT
Planning
The following comments related to planning are organized as follows:
• How the proposal relates to the Comprehensive Plan
• Review comments concerning the SP Conceptual Plan
• Community Meeting
Comprehensive Plan. Initial comments on how your proposal generally relates to the Albemarle County
Comprehensive Plan (Comp Plan) are provided below; additionally, comments regarding conformity with
the Comp Plan will be provided to the Planning Commission (PC) and Board of Supervisors (BOS) as part of
the staff report that will be prepared for the work session or public hearing.
The Comprehensive Plan designates this property as Institutional which allows civic uses, parks,
recreational facilities, and similar uses on County -owned property within Neighborhood 2 of the Places29
Master Plan.
This property is also zoned C1 Commercial which allows private school uses by Special Use Permit under
code sections 18-22.2.2(6) and 18-18.2.2(5) while section 18-22.2.1(b)(1) allows office uses in this area By
Right.
As the proposed private school and office uses will occupy an existing building and offer services similar to
those that are currently offered by the Senior Center, it is not expected that the new use will change the
overall character of the area or have a negative impact on density or traffic.
SP Conceptual Plan Review. The comments provided below relate to the submitted conceptual plan.
1. It is acknowledged that the County GIS may be misrepresenting the boundary line for this site.
According to the original 1990 site plan (pictured below), the boundary line between this building
and 485 Hillsdale Dr should actually be along the third shared parking lot tree island strip to the
south of the current Senior Center building. Please amend the conceptual plan to show the
boundaries as depicted on the deed plat or provide a survey to demonstrate this boundary.
Since parking stalls will be removed to create room for the proposed outdoor recreation area, and
possibly to accommodate bus turning radii, indicate which parking spaces may be removed (see
Zoning and Transportation comments below). Note: Reconfiguring parking outside of these areas is
not recommended as it may trigger concerns from Fire Rescue.
Revise the floodplain limits to match those shown on the VFRIS website, LOMR effective date
3/22/2017.
Community Meeting. Since the Community Meeting required of all special use permit applications has not
yet taken place, additional comments regarding impacts to neighboring properties may be forthcoming.
Transportation Planning
The following comments related to on -site vehicular circulation have been provided by Daniel Butch:
4. Clarify the length in feet of full-size buses and provide autoturn analysis detailing the radius and
demonstrating the ability of buses to make the needed turns in the parking lot bus loop proposed.
Building Inspections
The following comments related to building inspections have been provided by Michael Dellinger:
5. Buildings undergoing a change in occupancy may require upgrades per the existing building code.
Contact Keith Huckstep, plans reviewer for Albemarle County, at 296-5832 in regards to whether a
building permit is needed as well.
Albemarle County Service Authority (ACSA)
The following comments related to ACSA have been provided by Richard Nelson:
6. Confirm if there will be internal renovations to the plumbing. If yes, proposed fixture counts will
need to be provided to confirm existing water meter size is adequate.
Draft SP Conditions
Staff have drafted the following conditions. Please note these are draft conditions and have yet to be
reviewed by the County Attorney's office and the Zoning Division.
1. Development of the use shall be in general accord with the conceptual plan titled "Virginia Institute
of Autism Adult Service Center" prepared by Timmons Group, with the latest revision date of
[XX.XX.XXXX], as determined by the Director of Planning and the Zoning Administrator. To be in
general accord with the Conceptual Plan, development shall reflect the following major elements
within the development essential to the design of the development:
a. Location of outdoor recreation area as shown on the plan.
Minor modifications to the plan which do not conflict with the elements above may be made to
ensure compliance with the Zoning Ordinance.
Maximum enrollment shall be 60 participants.
Normal hours of operation for the center shall be from 7:30am to 4:30pm provided that the
occasional program -related events may occur after 4:30pm.
Action after Receipt of Comments
After you have read this letter, please take one of the actions identified on "Action After Receipt of
Comment Letter" which is attached.

If you choose to resubmit, please use the attached form. There is no fee for the first resubmittal. The

Notification and Advertisement Fee

SITE PLAN
Planning
1. Changes to the approved site plan (SDP199000078) will require a minor site plan amendment.
2. Suggest using natural grass over artificial turf for the outdoor recreation area, given the proximity
to the stream and location within the 100ft stream buffer.
Engineering
The following comments related to engineering have been provided by Frank Pohl:
3. Show the area and limits of anticipated land disturbance that will be needed to develop the
outdoor area. If the area of disturbance is more than 10,OOOsf, a Virginia Stormwater Management
Program (VSMP) application will be required.
Zoning
The following comments related to zoning matters have been provided by Kevin McCollum:
4. Parking — Staff has no issues with the on -site parking or the proposed changes being made to the
parking area, converting some of the parking into greenspace, shown on the concept plan.
Additionally, the Site Plan shows 106 available parking spaces. Given the requirement of 80 spaces
for this use (69 staff and 11 open to visitors), there shall be sufficient parking on -site even with the
removal of up to 26 spaces.
Virginia Department of Transportation (VDOT)
Comments related to transportation have not yet been provided by Adam Moore, but will be forwarded to
the applicant upon receipt.

ACTION AFTER RECEIPT OF COMMENT LETTER
FIRST SET OF COMMENTS
Your project has been scheduled for a public hearing by the Planning Commission for July 30, 2019
which is 90 days from the date your application was accepted for review. State Code requires a 90-day
review by the Planning Commission unless the applicant requests deferral. As you will read in this
comment letter, staff recommends changes to your project to help you achieve approval. Without
these changes, staff cannot recommend approval to the Planning Commission.
To maintain the 90-day schedule with a recommendation for approval, revised plans must be
submitted by June 24, 2019. If you need more time to make these changes, and if you prefer to move
forward to the Planning Commission with a recommendation for approval, you must request deferral
by June 24, 2019. Instructions for requesting a deferral are outlined below.
By June 24, 2019, please do one of the following:
(1) Resubmit in response to review comments
(2) Request deferral, as required by Section 33.521, in these instances:
a. If you will not be resubmitting by June 24, 2019
b. If you will resubmit by June 24, 2019, but would like to receive comments on the
revised submittal, and understand the Planning Commission date will be later than
July 30, 2019
(3) Withdraw your application
(1) Resubmittal in Response to Review Comments
Please resubmit on or before June 24, 2019.
The application fee which you paid covers staff review of the initial submittal and one resubmittal.
Each subsequent resubmittal requires an additional fee. (See attached Fee Schedule.)
(2) Deferral requested
To request deferral, you must submit a request in writing to defer action by the Planning Commission
and Board of Supervisors. The request may be made by email. You may request a deferral for up to 36

months from the date your application was accepted for review, which is May 1, 2022. (This is based
on the Board of Supervisors' September 5, 2018 action.) However, all outstanding information
necessary for Commission action must be submitted by January 1, 2022, according to the published
schedule. (See Section 18-33.52 of the Albemarle County Code.)
(3) Withdraw Your Application
If at any time you wish to withdraw your application, please provide your request in writing.
Resubmittals
As stated above, a deferral does not preclude you from resubmitting the application to address
changes based upon the comments. If you would like to resubmit after you defer, you may do so
following the resubmittal schedule.
The application fee which you paid covers staff review of the initial submittal and one resubmittal.
Each subsequent resubmittal requires an additional fee. (See attached Fee Schedule.)
Failure to Respond
An application shall be deemed to be voluntarily withdrawn if the applicant requests deferral pursuant
to subsection 33.52(A) and fails to provide within 90 days before the end of the deferral period all of
the information required to allow the Board to act on the application, or fails to request a deferral as
provided in subsection 33.52(B) or (C).
Fee Payment
Fees paid in cash or by check must be paid at the Community Development Intake Counter. Make
checks payable to the County of Albemarle. Do not send checks directly to the Review Coordinator.
