INCOMPLETE APPLICATION
Re: Special Use Permit Application 2018-00013 Boyd Tavern Market

This letter is in response to the above Special Use Permit application, filed on August 8, 2018. Though this
application was filed more than 10 days ago, the Albemarle County Circuit Court (in Case No. CL18000232-00)
stayed the County's consideration of this application. The Court's Final Order in that case, which the County
received May 28, has now lifted that stay. Therefore, the above application is again before the County for review.
The above Special Use Permit application is incomplete, and in accordance with County Code Section 18-33.34(C),
cannot be accepted.
As noted on page 2 of the County's standard Application for Special Use Permit, the following "required
attachments [emphasis in original] & other information [are] to be provided for the application to be officially
submitted & deemed complete":
One (1) completed & signed copy of the Checklist for a Special Use Permit.
One (1) copy of the Pre -application Comment Form received from county staff.
Li One (1) copy of any special studies or documentation as specified in the Pre -application Comment Form.
Because none of the above three requirements was submitted (as acknowledged on the enclosed application itself),
the above application cannot be accepted.
You may resubmit a completed application in accord with County Code § 18-33.34(C)
Please note that this letter applies only to SP2018-00013 and does not affect the applications pending in SDP2018-
00086 or SP2019-00006.
If you are aggrieved by this determination, you have a right to appeal it within ten (30) days of this notice, in
accordance with Virginia Code § 15.2-2311; provided, however, that a ten (10) day appeal period applies to appeals
of decisions pertaining to temporary or seasonal commercial uses, and such appeals shall be filed within ten (10)
days after this decision. If you do not file a timely appeal, this determination shall be final and unappealable.
An appeal may be taken only by filing an appeal application with the Zoning Administrator and the Board of Zoning
Appeals, in accordance with Albemarle County Code § 18-34.3, along with a fee of $258 plus the actual cost of
advertising the appeal for public hearing.
Applications for Appeal of the Zoning Administrator's Determination are available at the Department of Community
Development located at 401 McIntire Road, Charlottesville, Virginia 22902 or online at www.albemarle.org/cdapps.
This form applies to appeals of decisions of the zoning administrator or any other administrative officer pertaining to
the Zoning Ordinance.
