This letter is in response to the application for Final Site Plan review filed on August 8, 2018. Though this
application was filed more than 10 days ago, the Albemarle County Circuit Court (in Case No. CL18000232-00)
stayed the County's consideration of this application. The Court's Final Order in that case, which the County
received May 28, has now lifted that stay. Therefore, the above application for Final Site Plan is again before the
County for review.
Pursuant to Section 32.4.3.1 of Chapter 18 of the Albemarle County Code, your application for Final Site Plan
review is incomplete, and cannot be accepted for official submittal. The reason for the disapproval, with citation to
the applicable section of law, and what corrections or modifications will permit acceptance of the plan are indicated
below.
1. The Special Use Permit required by Albemarle County Code § 18-22.2.2 was not approved prior to
submittal of the final site plan. Condition # 1 of the conditional initial site plan approval for SDP2017-
00009 Boyd Tavern Market (dated May 10, 2017) stated, "... a Special Use Permit (SP) ... will need to be
approved prior to submittal of the final site plan." Because an SP for the use proposed with SDP2017-
00009 has not been approved, the present application is incomplete.
Pursuant to Section 32.4.3.1(e) of Chapter 18 of the Albemarle County Code, within 15 days after this notice, the
developer may resubmit the final site plan together with payment of the fee for the reinstatement of review ($258).
In the event the developer fails to resubmit the plan and required fee within the fifteen (15) day period, the plan shall
be deemed to be disapproved and a new application and fee shall be required for submittal of the plan. Please
contact me at your earliest convenience if you have any questions or require additional information.
Please note that this letter applies only to SDP2018-00062, and does not affect the applications pending in
SDP2018-00086 or SP2019-00006. Thank you.
