Unfortunately,there is some ambiguity between what the drawings show and the height specified: the monopole is indeed 135'tall, and we are fine with that limitation; however,the antennas, based on the zoning drawings have the pole top as the RAD center, meaning they were designed to extend up to 138'. Please let me know your opinion of the County's approval with respect to height of the overall facility. If the overall facility is to be no taller than 135',we will have to ask Shentel to change their design. However, if the monopole is to be no taller than 135' and the facility may be constructed as shown in the zoning drawings, then the design is fine as it is. Thank you, Lori Lori H. Also, assure that when your engineers are finishing this up they revise the location of that access road on all additional sheets in the plan which depict the old location of the access road(Z-11,Z-12). The above is needed to assure Condition#1 is accurate when it references the date of the plan the BOS is acting on: "The development of the site,and any modifications to the arrays,shall be in general accord with the plan titled "Milestone Connnunications—Shentel at Stony Point Volunteer Fire Co."prepared by John Caborgoudy,and dated 9/19/17(hereafter "Conceptual Plan"),as determined by the Director of Planning and the Zoning Administrator.To be in general accord with the Conceptual Plan,development and use shall reflect the following major elements within the development essential to the design of the development,including but not limited to all concealment elements and technique as shown and described on the Conceptual Plan and mentioned below: a. Height(135 feet tall) 1 b. Monopole location c. The farthest point of the back of the antennas shall be no more than 18 inches from the monopole Minor modifications to the plan which do not conflict with the elements above may be made to ensure compliance with the Zoning Ordinance." So here is my game plan. I am going to change condition#1 in the transmittal to the BOS from the 9/19/17 reference to the 10-10-17 reference. Your team needs to assure all sheets are revised with correct 10-10-17 dates for the BOS to act. How does this sound to you? This set of drawings has been sent to the Fire Company for review and approval but has not yet been reviewed and approved by them, so I don't plan to include it in my PowerPoint or pass it out to the Planning Commission. These "concealment elements" are established and relied upon by the County in siting PWSFs as specified in section 5.1.40(b) of the Zoning Ordinance and the PWSF Policy/Comprehensive Plan. If the facility were raised in height further above the tree line, the visibility of the facility may be increased beyond acceptable levels. Notably, this application requires two public hearings prior to action(approval or denial). The meetings are not yet officially scheduled nor advertised but they are anticipated/tentatively scheduled to be on October 10 and then in Nov 8, based on the FCC shot clock deadlines an action shall be taken no later than Dec 14th. As we move through the review we'll have a more solid understanding of the meeting dates and they will be advertised in the newspaper. As mentioned over the phone, the County cannot review the tower for health effects; rather, the FCC regulates this aspect of these facilities. Localities can only review these facilities based on land use issue to include visibility. Here is a LINK to Section 5.1.40 of the County Code that this tower will be reviewed under. Additionally, this LINK is to the County's Personal Wireless Service Facility Policy. It explains what the County deems acceptable for visibility and what it does not deem acceptable.Notably, these facilities are not meant to be invisible; rather, minimizing visibility is the key. After that phone call I am less concerned about the potential threat level at the community meeting. Additionally,he has not actually threatened anyone yet and has stuck to the issues at this point, even if his delivery is very emotional,highly charged, accusatory, and distrustful of government. I will talk to Lori about her concerns and formulate a plan with her on how to keep the meeting under control based on the anticipated number of attendees now that the parents of the students are being notified by the principle. I really appreciate you going straight to Mark with the safety concerns; however, fundamentally I disagree with the response that the answer is that the applicant can hire an off duty police officer to handle such concerns. These community meetings are mandatory for an SP,therefor if an applicant or staff member has a legitimate concern about safety at one of these meetings because of a citizen or a group of citizens being overly aggressive or threatening,there should be no hesitation on the County's part as to whether security is brought to the meeting. The nature of this job is that we are constantly working with and making decisions on people's property rights,their land values, and issues of their neighborhoods...these kinds of issues directly affect the personal lives and finances of the citizenry. My concern is really for the parents of the children who will be involuntarily receiving all this extra radiation while they are at school everyday, throughout the school year. I've talked to you and you've told me that letters were mailed to all neighbors within a half mile, however that doesn't include our neighbors right across the street at the school, those kids who are most susceptible to the radiation and by the way as you suggested I've been doing my own research and I am very concerned with what I have found. So again back to the parents, I have talked to the principal across the street and he has no knowledge of this, I've been to the county's website, the school website and there is no mention of this. And it seems like this balloon test is going to be held either on the first day of school or the day before, now a law firm has been hired I guess to convince all of us locals that this is okay. I'm not sure why a law firm has been hired since their job is lawyers convince people, they make arguments. You know I think it makes more sense to have, like a radiologist or you know somebody like that, I'm sure you will probably- have one at the meeting whose on the payroll there for the tower folks. It's a little slick that there is a law firm here that we've heard nothing from the people at the firehouse, you know we haven't heard anything from them and how they stand to gain from this, how much they want this to happen. We,have gotten a letter from LeClairRyan and you know they are attorneys; so that's pretty slick, especially since you don't intend on notifying these children, or im sorry" the parents of the children. Now again, first day of school coming up I would think that you would rather the parents hear about this from you, from the county, or from the firehouse, rather than me or the entire street that I live on which in front of the school being clustered with signs asking how much radiation is enough for your kid, a sign stating keep cell phone towers away from our elementary school, I mean I think that is going to cause a lot of concern especially on the first day of school especially if the county hasn't notified them and they are only finding out by these roadside signs littering the streets up and down Stony Point Road right across the street right across the street from the Elementary School. So I've talked to my neighbors and this sign thing is looking pretty promising, you know we are going to have the whole street covered and you know Mr. Christopher Perez the guy in charge of this for the county he's not returning my call, I've left two messages, with two simple questions. 1) Do you think this is an appropriate installation right next to an Elementary School? 2) Do you think it is wise? Don't you think the parents deserve to know well, he's not returning my call I guess he doesn't want to answer my questions, but I can understand why given the position that he is in. So, I'm just imploring with you Lori to let these parent know what their kids are going to be receiving in school and I don't mean an education I. meal all that extra radiation. I mean we've all got smart meters in for our power meters outside delivering radiation. I have high voltage wires behind my house as well as in trash cans on a stick. The last thing I need is more radiation from a 138 foot tower, so again I implore you to contact the parents or implore you to urge the county contact these parents its simply not right for the parents not to be aware of this. It makes no sense to me for you to mail a letter to everyone within a half mile or well what about the kids, the kids are going to be closer to this than anyone else and you are not going to inform the parents in any way shape or form? I mean as parent, don't you think that is wrong? I mean I know you are here to convince us that this is right and this is all good and that we should just relax because it's federally regulated and under the current administration that really scares me, that really really scares me.
