Proposed Variance
The applicant requests relief from Section 21. 7.2 of the Albemarle County Zoning
Ordinance to allow a storage shed (accessory structure) to be located 5 feet
from the side property line, a variance of 45 feet; and 5 feet from rear property
line, a variance of 45 feet.
Zoning Ordinance Requirements
Pursuant to Section 21.7.2, adjacent to residential and agricultural districts:
No portion of any structure except signs advertising sale or rental of the prop-
erty shall be located closer than fifty (50) feet to any residential or agri-
cultural district. No off-street parking or loading space shall be located
closer than twenty (20) feet to any residential or agricultural district.
Staff Comments:
Applicant wishes to construct an accessory storage building at the rear canner
of the property. The setback indicated should be changed to six (6) ft. instead
of the five (5) ft.
Residential property abuts the applicant's property on both sides and rear.
The setback for structures from residential property is fifty (50) feet. As
per the width of the applicants lot of 113 feet, the 59 foot setback would
only leave a 13 ft. buildable area to locate the accessory structure: Prop-
erty to the rear and the side adjacent to the proposed structure is undeveloped.
Other than the limited area in the rear of the property, the accessory building
would have to be located in front of the main building.
The proposed location of the storage building because of the undeveloped prop-
erty would not be any deterrent providing that the condition of approval be
limited to storage only.
If the board wishes to grant the variance, it will be with that condition.

Checked with Andy to see if would need another variance from 4.11.3.2 (b)
since closer than 6 feet to property line. He stated that Ms. Webster
might agree to locate the shed 6 feet since she had requested 5 feet.
On 3/2/84 I called and spoke with Ms. Webster & asked her if she could
meet 6 feet from side and rear property line since it was not advertised
from the other section. Ms. Webster indicated that 6 feet would be fine.
Make sure to include in staff report.
