Church of God, Trustees of c/o Hersel Daniel Tax Map: 56A (1) Parcel: 1-12 Zoned R-2 Existing Activity Church & Parsonage Proposed Variance The applicant requests relief from Section 4.6.3.2 of the Albemarle County Zoning Ordinance, to allow a structure to be 3 ft. from road right-of-way, a variance of 22 ft. Zoning Ordinance Requirements Pursuant to Section 4.6.3.2, other yards adjacent to streets shall have a minimum width or depth, as the case may be, of eighty (80) percent of the minimum front yard depth required in the district in which the lot is lo- cated. This provision shall apply to lots in the RA or residential districts only. Staff Comments: The applicant (Church of God) wishes to add a substantial addition to the existing church structure, which would be located three (3) feet from an access easement. The fifty (50) foot access easement is gravel and has not been developed in terms of a more permanent road with drainage facilities, etc. In review of the total lot area additional building could be added to meet setback requirement. This would require relocation of the parking area as shown on the drawing submitted. Structurally and design wise, the applicant should show the warranty for the encroachment to the road right-of-way.
