Proposed Variance
The applicant requests relief from Section 10.4 of the Albemarle County
Zoning Ordinance, to allow a subdivision of a 1.0 acre lot, a variance of
1.0 acre; also request relief from Section 10.4 to allow 158.33 feet of
road frontage , a variance of 91.67 feet.
Zoning Ordinance Requirements
Pursuant to Section 10.4, all structures shall be located a minimum of 75 feet
from a right-of-way, and minimum frontage existing public roads shall be 250 feet.
Staff Comments:
The applicant wishes to subdivide property and create a one (1) acre lot.
Located on the one (1) acre lot is a mobile home, garage and accessory buildings.
In 1970 the adjoining parcel of two (2) acres was acquired and added to a one acre
parcel. In 1977 a .5 acre and .250 acre parcel was added to the Freeman's property
- the 2.0 acre and 1 acre parcels. In 1977 additional parcels of .250 acres
and .5 acres were added to the existing parcel of three (3) acres.
The minimum acreage in the RA (Rural Areas) District is two (2) acres. When
the two (2) acre parcel was added to the one (1) acre parcel, this made it
conform to the basic area requirements of the ordinance.
The intent of the Rural Areas District is not to have strip development along
the road side. A division of this parcel creates the need for the road frontage
variance. This also would be needed for the remaining acreage which has 217 ft.
of frontage.
A hardship cannot be found in review of the application. Based upon the infor-
mation received and in review of the ordinance requirement, we ask the Board
to deny the variance.
