Pezmit# rV Building Pezmi.t# to STAFF REPORT - VA-84-12 Applicant: Carl & Peggy Vandevander Tax Map/Parcel: 103 - 43B5 Acreage: 2.039 Zoning: RA (Rural Areas) Location: East side of Route 795, one mile from intersection of Route 620. VARIANCE REQUEST The applicant requests relief from Section 10.4 of the Albemarle County Zoning Ordinance to allow an addition to a single-family dwelling to be located 21 feet from the side property line, a variance of 4 feet. AREA CHARACTERISTICS The location of the proposed addition is reasonably level as well as the adjoin- ing two lots. This is a rural area which has single family residences located on 2± acre lots (Deeridge Subdivision) of which all lots front on Route 795. Located on the applicant's lot is a single-family residence, garage, and a (garage type) shed. Both properties that adjoin this lot have single residences. COMPREHENSIVE PLAN The use of this area is for agriculture and allows for rural development as does exist at this time. Such a variance as the proposed addition to a single-family residence does not make a change in its single family development rights. STAFF COMMENTS As required by Section 10.4 of the Zoning Ordinance, a 25 foot setback from the side property line is to provide for residential separation. The provision is for adequate light and air, and prevents loss of property from fire and other dangers. STAFF RECOMMENDATION In review of the application, the yard requirements should not be reduced unless these requirements reduce the buildable area to an unreasonable dimension. By reducing the side yard setback it diminishes the light and air, and increases the loss from fire and other dangers. It is found that the denial of this var- iance would not restrict the applicant from a reasonable use of this property, therefore, the staff recommends Ap .reval.
