STAFF REPORT - VA-84-13
Applicant: Earl Wilson O'Brien Estate
Tax Map/Parcel: 129/7B
Acreage: 31.4 acres
Zoning: Rural Areas (RA)
Location: North side of Route 6, ± 4 miles West of Scottsville Shopping
Center
VARIANCE REQUEST
The applicant requests relief from Section 30.5.2.2 to allow a single-family
residence to be located 55 feet from a scenic highway; a variance of 95 feet.
AREA CHARACTERISTICS
The applicant's property has hilly as well as generally level areas and slopes
off into a ravine to the rear of the property. A single-family dwelling, two
mobile homes and the vacant structure presently occupy the site. The vacant
building was previously used as a country store with gas pumps.
The surrounding area consists of large farms and is sparsely populated.
ZONING HISTORY
Not applicable
COMPREHENSIVE PLAN
The Land Use Plan designates this area as rural and area along Route 6 is further
protected by the Scenic Highway overlay district. The proposed use of the vacant
structure complys with the Comprehensive Plan.
AGENCY COMMENTS
None
STAFF COMMENTS/RECOMMENDATION
The proposed single-family dwelling would be a less intense use. The residential
use would also be more conforming to the Land Use Plan.
The proposed use is not viewed as a special privilege or a convenience. Conse-
quently, the strict application of the Zoning Ordinance could be construed as an
unreasonable restriction on the use of this property. Also, this problem is u-
nique in that the hardship is not generally shared by adjacent property owners.
Moreover, the proposed use poses no substantial detriment to adjacent property
owners, nor does it change the character of the district.
Based upon the above, the staff recommends approval of the requested variance.
