Location: At the intersection of Routes 708 and 787 generally northeast
of Peacock Hill in the Samuel Miller District.
VARIANCE REQUEST
The applicant requests relief from Section 4. 1.6 to obtain a variance of 100%
future replacement site in order to utilize a current (1978) Health Department
sewage disposal system construction permit for a 2 bedroom house.
AREA CHARACTERISTICS
The applicant's site and adjacent areas consist of moderate to severe slopes.
The applicant's site is presently vacant. There are numerous homes built in the
adjacent area.
ZONING HISTORY
Not applicable.
COMPREHENSIVE PLAN
The applicant's proposed use complies with the Land Use Plan.
AGENCY COMMENTS
Please see attached Health Department letter from Jeffrey McDaniel.
STAFF RECOMMENDATION
The Zoning staff recommends approval of the requested variance based on the
following:
Staff opinion is that an unnecessary hardship exists because; (1)
strict application of the Zoning Ordinance would prohibit the
residential use of this lot and may be termed confiscatory; (2)
the proposed use of the property does not violate the intent of
the Zoning Ordinance in that no substantial detriment to adja-
cent property owners is perceived nor would the variance change
the character of the district.
The staff further recommends that approval be conditioned upon allowing a two
bedroom residence only and that the site be disturbed as little as possible
during construction due to the severe slopes. The latter condition would re-
quire review by the Engineering Department and that the applicant adhere to any
conditions they may impose.

Dear Mrs. Singh:
My letter is in regard to your request of February 21, 1984, on information
regarding setback requirements of property known as County tax map 57, parcel
85 Al. This parcel is located at the intersection of State routes 787 & 708.
As stated as Jesse Hurt's letter of November 17, 1980, the lot is considered
to be a corner lot. The front of the lot is deemed to be the shorter side
fronting on a street, which is State route 787. As provided in Section 2.6.2, .
the side yard on the side facing the side street (Route 708) shall be thirty (30)
feet or more for both main and accessory buildings. The other or remaining prop-
erty boundary would be a side yard, which under Section 2.5. 1 shall be twenty-
five (25) feet or more for main structures.
Upon review of the plat the setbacks could be met, but a very limited area
remains where a residence could be located. Being a buildable lot would depend
upon Health Department approval for the location of the septic system. Again
I'm stating that a limited buildable area exists if on this lot that the set-
backs could be met, but cannot actually be determined upon until field work is
done for the location of the residence.

Ms. Singh:
In July 1978 a permit was issued to install a septic system for a
two bedroom house on Parcel 2 - Skyline Crest Subdivision. There was
a very small area available for the septic system which limited the
house size. This small space is still available for a system to serve
a two bedroom house, but it would not provide any reserve area.
Since the new Albemarle County ordinance requires not only a site
for the drainfield but an alternate site for repair, it will be impossible
to renew the existing permit.
To satisfy these new regulations two suitable drainfield sites (each
50 ft. by 100 ft.) will he necessary along with a house site and a well
site. To accomplish this. I believe it will be necessary to purchase
additional property.
If any alternative can be proposed we will be happy to review the
plans.

Dear Mrs. Singh:
This is a follow-up of our conversation of last Thurlday concerning
the setbacks for a lot at the intersection of Route 787 and 708.
This lot is a corner lot and of the two sides of a corner lot, the
front shall be deemed to be the shortest of the two sides fronting on
streets. Therefore, the shortest side is fronting on Route 787 which
requires a 75 foot setback from the right-of-way of this road. The rear
yard setback is 35 feet and the side yard setback is 25 feet.
After making an on-site inspection and checking the dimensions, 1
have determined that this is a buildable lot but must comply with the
setback regulations. The property lines must be staked before a footing-
inspection can be made by our department.
