Location: Fronts on southeast side of Route 620 approximately 3/10 mile
north of Route 708 and 618 intersection
VARIANCE REQUEST
The applicant requests relief from Section 10.4 of the Zoning Ordinance to
allow the location of an accessory structure (garage) 50 feet from the front
property line, a variance of 25 feet.
AREA CHARACTERISTICS
The applicant's property is located in an area that is sparsely developed with
single family residences and small farms. The front portion of the applicant's
property is level but the rear topography drops off severely. A residence and
two accessory structures presently exist on the site.
ZONING HISTORY
Not applicable
COMPREHENSIVE PLAN
The Land Use Plan designates this area as rural. The applicant's proposal does
not impact the Land Use Plan.
AGENCY COMMENTS
None
STAFF COMMENTS
The applicant proposes to erect a garage toward the front portion of his property.
As previously mentioned, a residence and two accessory structures exist on the
site. All three structures are set approximately 50 feet from the property line.
It can be argued that the strict application of the Zoning Ordinance would
unreasonably restrict the use of the property by reason of the severe topography
on the site. However, the applicant already has two accessory structures which
might preclude such an assumption. Unless the applicant can present proof that
a hardship would exist without construction of the third accessory structure,
the staff is of the opinion that no hardship exists.
STAFF RECOMMENDATION
Based upon the above, the staff recommends denial of the requested variance.
