Clerk' s fee k'. • _ TESTS: f flat SI`h: �i %:/j�J1jtSIi,1:.L, CLLLK Grantor' s tax i '�' �LcpuLy Clerk Nom, roe STAFF REPORT - VA-84-20 Applicant: Paul Grady, Jr. Tax Map/Parcel: 59/15 Acreage: 5.02 (total acreage) Zoning: Rural Areas, RA Location: South side of Route 250 West adjacent to the 1740 Antique Shop VARIANCE REQUEST The applicant requests relief from Section 10.4, Area & Bulk Regulations, to allow the creation of a lot with 65 feet of road frontage, a variance of 185 feet; to allow a residence (mobile home) to remain on the property located 20 feet from the rear property line, a variance of 15 feet; and to temporari- ly allow 4 mobile homes (by definition) on 4.0 acres, an area variance of 4 acres. AREA CHARACTERISTICS The front portion of the property is level and slopes up rapidly to a plateau area toward the rear of the property. Presently, a nonconforming mobile home park consisting of 5 mobile homes exists on the property. The applicant ul- timately proposes to remove 3 of the mobile homes leaving only two on the site. The applicant has provided the staff with the following "mobile home removal schedule" in writing. 1. The mobile home which is presently occupied and would be located on the 1.02 acres will be removed from the site by September 1, 1984. 2. One of the mobile homes on the rear plateau area of the site will be removed immediately. 3. Another mobile home on the rear plateau area of the site which is presently occupied will be removed by April 1, 1985. This removal schedule would bring the property into conformance with the Zoning Ordinance. The applicant is seeking this variance to allow him to sell 1.02 acres to the adjacent property owner, 1740 House Antique Shop. All of this immediate area (approximately 50 acres) historically made up the 1740 House tract. Due to an estate settlement, the tract has been subdivided off since the early 1900's. The 1.02 acre parcel contains the original well site for the 1740 House and is of some archaeological significance. ZONING HISTORY None STAFF REPORT - VA-84-20 Page 2 COMPREHENSIVE PLAN The proposed use conforms to the Land Use Plan. AGENCY COMMENTS Not applicable STAFF COMMENTS The staff is of the opinion that the applicant's problem is unique in that it is not generally shared by adjacent properties. Also, no detrimental effect will occur to adjacent property owners should the variance be approved nor would it change the character of the zoning district. In addition, the applicant's proposal will result in a use that conforms to the Zoning Ordinance. Finally, the staff does not consider the variance request to temporarily allow 4 mobile homes on 4 acres to be in conflict with the density question as pre- sented in the special staff report. This is true because the request actually reduces the density and most importantly provides an interim solution to a problem that would ultimately conform to the Zoning Ordinance. I can see no objection to this proposal. It would be doubtful that any portion of the 1.02 acre tract could be used for future drainfield, due to the setback requirements from the stream and the existing well. Since the trailer that is using this area is being removed, the possibility of failure of the existing septic system will also be removed. Tompkins VA-84-20 Zoning Administrator Dear Mr. Tompkins: This is in reply to your letter dated April 26, 1984, regarding notification to adjacent property owners of Paul Grady preliminary plat of subdivision of his property (VA-84-20) and his request for relief from Section 10.4 of the County Zoning Ordinance, which will allow him to deed us 1.02 acres which connects to the eastern boundary of our present property, the historic 1740 House-D.S. Tavern. As historic preservationists, we are vitally concerned with the proper development of Albemarle County, especially along Route 250 West, recently designated a Virginia Scenic By-Way. We purchased our property in 1976 and have subsequently been devoted to the restoration and development of its historic potential. In 1983 we were fortunate in obtaining a major objective: its designation as a Virginia Historic Landmark and its placement on the National Register of Historic Places. We feel that it would be highly significant to be able to acquire the 1.024.acres as it will enable us to enhance and improve physically and estSically the historic setting of this valuable Albemarle County Landmark. Specifically, it will allow us to retrive an important portion of the tavern's original setting along its road frontage, to remove highly visible and unattractive elements from the historic road-front scenery, especially house-trailers and dismantled buildings now stored there, to provide us with an important archaelogical site as the tavern's old well and other dependencies were definitely located there, to improve the site esthetically with appropriate landscaping and maintenance, and to obtain our existing well-water site which is now located there. We anticipate a favorable review of the above referenced plan.
