Ragland Tax Map/Parcel: 62/44 Acreage: 1.006 acre Zoning: Rural Areas (RA) Location: Fronts on east side of Route 769 approximately 3/10 mile northwest of Route 769 and Route 20 intersection VARIANCE REQUEST: The applicant requests relief from Section 10.4 of the Zoning Ordinance to allow an addition to a single-family dwelling to be located 20 feet from the side prop- erty line, a variance of 5 feet. AREA CHARACTERISTICS The applicant's property is located immediately adjacent to Key West Subdivision on a parallel road. The applicant's lot slopes moderately towards Route 769 and is moderately wooded. The lot is nonconforming and very narrow (slightly less than 99 feet where the existing structure is located) . The remainder of this immediate area is residential in character. ZONING HISTORY Not applicable COMPREHENSIVE PLAN: The applicant's lot is located within the urban area and the Land Use Plan designates this area as low density (1-4 du's/acre) residential. The applicant's proposal maintains the intent of the Land Use Plan. AGENCY COMMENTS None STAFF COMMENTS The applicant proposes a modest addition to his home that would encroach the required side yard setback by 5 feet. It is the staff's opinion that a hard- ship exists in this case. The applicant has shown that this property was ac- quired in good faith and by reason of exceptional narrowness of the lot, the use of the property would be unreasonably restricted should the strict appli- cation of the Zoning Ordinance be enforced (see Section 34.2) .
