( 9 Final DecisionMade: The variance sought denied/dp�roved with the following conditions: ( JQc Special 1 Use Permi.t 11 , OF APPEALS • Sign Permit-1 /-i - 02g S -S1,1 - 46 1 dIl au � /� -* PNri 7 ding PP-r-n'i t# t Rair vie STAFF REPORT - VA-84-26 Applicant: Fruit Growers Co-op Corporation Tax Map/Parcel: 56A (1 & 2)/01-65, 01-27 Acreage: 1.570 acres Zoning: Commercial (C-1) Location: At the intersection of Route 810 and 240 in Crozet VARIANCE REQUEST The applicant requests relief from Section 21.7. 1 of the Albemarle County Zoning Ordinance to allow a covered walkway attached to the main structure to be located 20 feet from the front property line, a variance of 10 feet. AREA CHARACTERISTICS This immediate area is commercial in character. Fruit Growers Co-op consists of several nonconforming commercial structures that offer numerous types of sales and services. The new Crozet Public Library exists opposite Fruit Growers and a service station exists at the corner. ZONING HISTORY Several (4) variance requests have been heard by the Board regarding Fruit Growers. VA-79-26, 51 and 64 all involved Section 7-2 of the previous Zoning Ordinance. Section 7-2 required 40,000 square feet per establishment when served by either a central water or central sewer system. The following is a brief summary of the Board's actions on those cases: 1. VA-79-26: denied, June 12, 1979. 2. VA-79-51: denied, September 11, 1979 because a quorum vote was not present. The Board allowed the applicant's case to be . re-heard the following month . 3. VA-79-64: approved, October 9, 1979 with conditions (see attached) . The fourth case, VA-81-36, was approved on June 9, 1981 by the Board. The applicant was granted relief from Section 4. 12.6.6. 1 of the Zoning Ordinance to reduce the number of required off-street parking spaces. AGENCY COMMENTS None STAFF COMMENTS The applicant proposes to attach a covered walkway to the existing hardware store which would extend 10 feet into the required 30 foot setback from public street right-of-ways. The walkway will have a mansard roof. �wr vie STAFF REPORT - VA-84-26 Page 2 It is the staff's opinion that the walkway would promote the health, safety, con- venience and general welfare of the public which is a basic intent of the Zoning Ordinance as stated in Section 1.4. Also, in accordance with Section 34.2 of the Zoning Ordinance, if the applicant can show that by reason of exceptional size or shape of a specific piece of property. . . , or of the use or development of property immediately adjacent thereto, the strict application of the Zoning Ordi- nance would prohibit or unreasonably restrict the use of the property, the Board may grant exception to that section. The Board's action is further justified provided that all such variances are in harmony with the intended spirit and purpose of this ordinance. STAFF COMMENTS Based upon the previous statements, the staff recommends approval of the requested variance. Should the Board agree with the staff's recommendation, I further rec- ommend that the Board states that approval of this case should not be perceived as setting precedent for any similar future cases.
