Burcham Tax Map/Parcel: 103/55L Acreage: Zoning: RA (Rural Areas) Location: NE side of State Route 795, ± 1/4 mile north of the intersection of Route 795 & Route 620 VARIANCE REQUEST The applicant requests relief from Section 6.5.01 of the Albemarle County Zoning Ordinance to allow a wood shed to be located 31 feet from front property line (Route 795) , a variance of 24 feet. AREA CHARACTERISTICS The proposed location of the accessory building is the only fairly level area of the lot. There is a natural drainage swale that runs through the center of the lot. There is a barn located on the north side of this lot. On lot 9, the adjoining lot, there is located the applicant's residence and a family members residence. The property fronts on State Route 795. COMPREHENSIVE PLAN The property is located in the rural area which is scarcely populated. Most of the adjoining properties are of small acreage. The variance impact is minimum because of the structure being an accessory building but should be viewed in regard to a hardship. STAFF COMMENTS The applicant is asking for a variance for setback of an accessory building. The plat was approved in 1962 with a 55 foot building line, which was prior to the adoption of any Ordinance regulations. The Ordinance provides for previously approved subdivision plats to adhere to the setbacks as indicated. In the rural areas the setback was 30 feet unless otherwise indicated - until Octobery1976 when the requirement was changed to 75 feet and thus forwarded til the present. STAFF RECOMMENDATION We find that there is a very limited area that the shed could be located even at the 55 foot setback. At the prescribed setback, the topography is such that it does restrict the applicant in a suitable physical location for the accessory building.
