Buyer represents that an inspection satisfactory to buyer has been made of the property,and Buyer agrees to accept the property in
its present condition,except as may be otherwise provided herein.
Seller warrants all mechanical systems and equipment to be in good working order at closing.
The Seller understands that the risk of loss is on them prior to passing of deed. Buyer has the right to increase the insurance for his

STAFF REPORT - VA-84-29
Applicant: Arthur John Sullivan, Jr.

Location: North side of Route 640 approximately one (1) mile east of
intersection with Route 20 North
VARIANCE REQUEST
The applicant requests relief from Section 10.4 of the Albemarle County Zoning
Ordinance to allow a parcel to have 210 feet of road frontage, a variance of
40 feet.
AREA CHARACTERISTICS
Most of the entire parcel is of a sloping terrain with the exception of several
building sites. The topography of the property is of a 10 to 20 degree gradual
slope from the road frontage to approximately 500 feet deep, and from that point
steeper. The front area is open pasture land, and the rear most part is wooded.
There are two (2) small parcels with one residence on each surrounding the 45
acre tract. To the west of this tract is also a single residence. This area
is the rural part of the county which requires well and septic.
COMPREHENSIVE PLAN
The rural area where the property is located speaks to agricultural and forestry
uses. The random location of residences is customary to the character of such
areas. The requirement of 250 feet of road frontage is to deter strip develop-
ment along rural roads.
AGENCY COMMENTS
The approval of any residential construction would be subject to Health Department
approval of their septic system respectfully.
STAFF COMMENTS
The division of land into smaller parcels is a very common occurrence. The divi-
sion of this 45 acre tract is such that the applicant is trying to achieve some
type of building site for each parcel.
STAFF RECOMMENDATION
We cannot find that there is a hardship because the property can be divided, but
not by the number desired. The reduction of the number of divisions does not
restrict the applicant from the reasonable use of the property, so we cannot
recommend approval.
